Ansars Force Act, 1995

Act No.3 of 1995

An Act made to provide for the constitution of the Ansars Force

Whereas it is expedient to constitute the Ansars Force and to make provisions relating thereto;

Now, therefore, it is enacted as follows:-

1. Short title.- This Act may be called the Ansars Force Act, 1995.

2. Definitions.- Unless there is anything repugnant in the subject or context, in this Act-

a) "regulation" means any regulation made under this Act;
b) "Force" means the Ansars Force constituted under this Act;
c) "rule" means any rule made under this Act;
d) "Director General" means the Director General appointed under section 4.
3. Constitution of the Ansars Force.- (1) There shall be constituted a Force to be called the Ansars Force in accordance with the provisions of this Act.
(2) The Force shall be a disciplined force within the meaning of the definition of "disciplined force" given in article 152 of the Constitution of the People's Republic of Bangladesh.

4. Supervision and management.- The Force shall be under the permanent supervision of the Government and shall be managed by a Director General appointed by the Government in accordance with this Act and the rules and, subject to their not being inconsistent with this Act and the rules, such orders and directions as the Government may pass from time to time.

5. Officers, employees etc. .- All officers and employees in the organizational skeleton approved by the Government for the Ansars Department shall be deemed to be officers and employees of the Force.

6. Classification, etc. .- (1) The Force shall consist of two classes of Ansars, namely:-

a) the common Ansars; and
b) the affiliated Ansars.
(2) The two classes of Ansars mentioned in sub-section (1) shall be enrolled and affiliated, respectively, in such manner as may be prescribed and their allowance, apparel, training etc. shall be determined by regulations.
(3) The common Ansars shall serve as volunteers and the Director General or any officer authorized by him in this behalf may, in times of national emergency, if necessary, call upon them to perform duties as volunteers.
(4) The affiliated Ansars shall be appointed for a fixed period for the purpose of discharging, on request of any institution or organization, by direction of the Director General or of any officer authorized by him in this behalf, any security and law and order function.

7. Ranks of the Force.- The Ansars Force shall have all or any of the following ranks, namely:-

a) thana company commander;
b) deputy thana company commander;
c) platoon commander;
d) deputy platoon commander;
e) havildar;
f) corporal;
g) lance-corporal;
h) ansar
8. Constitution of Ansar units.- The Director General may, on consent from the Government, constitute in every Zila one or more Ansar units of the Force and the constitution, management and control of such units shall be prescribed by rules.

Explanation.- In this section, unit shall mean section, platoon company and batallion.

9. Functions of the Force, etc. .- (1) The main functions of the Force shall be-

a) to render assistance to the Government or any officer under the Government in public security measures and to take part in any security measures;
b) to take part in any public welfare measures directed by the Government for the purpose of improving the financial and social situation of the country.
(2) In particular, and without prejudice to the generality of the foregoing provision, the Force shall, by direction of the Government, render help and assistance to the following forces, namely:-
a) the Army;
b) the Navy;
c) the Air Force;
d) the Bangladesh Rifles;
e) the Police;
f) the Battalion Ansar.
10. Carrying of weapons and ammunition.- Subject to the policies made by the Government and the directions issued and conditions imposed by it from time to time, the Force may carry and use weapons and ammunition.

11. Obligation to comply with orders.- (1) Every member of the Force shall be bound to comply with any legal orders enforced on him by any appropriate authority.
(2) In the case of affiliated Ansars, the Police Act, 1861 (Act V of 1861) and the discipline provisions made thereunder shall be applicable.
