Land Appeal Board Act, 1989

ACT NO.24 OF 1989









An Act to provide for the establishment of a Land Appeal Board.

Whereas it is expedient to provide for the establishment of a Land Appeal Board;

It is enacted as follows:-

1. Short title and commencement.- (1) This Act may be called The Land Appeal Board Act.
(2) It shall be deemed to have come into force on the 2nd Caitra, 1395/16th March, 1989, respectively.

2. Definition.- In this Act, "Board" shall mean the Land Appeal Board.

3. Supremacy of the Act.- The provisions of this Act and the rules made thereunder shall have effect notwithstanding anything to the contrary contained in any other law for the time being in force.

4. Establishment of the Land Appeal Board.- (1) As soon as possible after the commencement of this Act the Government shall by notification in the official Gazette establish a Board called the Land Appeal Board.
(2) The Board shall consist of one Chairman and not more than two other members.
(3) The Chairman and the other members of the Board shall be appointed by the Government, and the conditions of their service shall be determined by the Government.

5. Functions of the Board.- The Board shall exercise the powers and perform the functions entrusted to it by the Government or by or under any law.

6. Appeal.- (1) Appeals against the resolutions of the Board may be submitted to the Government in a such way as may be specified by rule, and the decision taken on such appeal shall be final.
(2) The appeal must be submitted within 60 days after the resolution of the Board.
(3) The Board's resolution shall be suspended until the decision on the appeal.

7. Power to make rules.- The Government may by notification in the official Gazette make rules for the purpose of this Act.

8. Repeal and savings.- (1) The Board of Land Administration Act, 1980 (XIII of 1981), is herewith repealed.
(2) Notwithstanding anything contained in any other law, if at the time of repeal any matter is undisposed by the Board of Land Administration established under the repealed Act, it shall be transferred to the Government, and the Government shall either dispose of it itself or delegate it to the Land Reform Board or to the Land Appeal Board for disposal, and whichever Board it has been delegated to shall dispose of it.
(3) The Land Appeal Board Ordinance, 1989 (No.2 of 1989) is herewith repealed.
(4) Notwithstanding such repeal anything done or any action taken under the repealed Ordinance shall be deemed to have been done or taken under this Act.
