BERMUDA STATUTORY INSTRUMENT
AGRICULTURE (INSPECTION AND EXPORTATION
OF
NURS ERY STOCK) REGULATIONS 1931
[made under sections 23, 24 and 26 of the Agriculture Act 1930 [title 25 item 1] on 10 November 1932 and brought into operation on 7 March 1932]

FIELD INSPECTION OF EASTER LILIES
Inspection of Easter lily fields
1 All fields of Easter lilies shall be subject to inspection for the presence of virus and other diseases, and off-type and other undesirable plants.
Application for inspection
2 No fields of Easter lilies shall be inspected for certification except on application for inspection by the grower or approved co-operative or ganization to which he may belong.
Time for application
3 Application for inspection shall be made on or before the 1st day of January in each year.
Particulars to be given
4 In making application each grower shall furnish the following information, that is to say, the number, location and approximate area of each field of Easter lilies and the origin of the stock.
Further inspection
5 (1) Notification shall be made to the owner of every field of Easter lilies which can be brought to certificate requirements after the removal of undesirable plants, and the owner thereof should remove the undesirable plants and inform the Department within three weeks that the field has been made fit for another inspection.
(2) Failure to comply shall render the field liable to be con demned.
Certificates and notices
6 On or before the 1st day of June in each year certificates shall be issued with respect to fields of Easter lilies which have met the require ments of certification, and notice shall be given to owners of fields which have failed to meet such requirements.
Withholding of certificate
7 From every grower, who is in possession of a field of Easter lilies which has met the requirements and of a field which has failed to do so, certification of the approved field shall be withheld until the bulbs in the other field have been disposed of to the satisfaction of the Director prior to the 1st day of June.
Field condemned
8 In the case of any field of Easter lilies which, because of the presence in it of too high a percentage of diseased or off-type plants, cannot, in the opinion of the Director, be made fit for shipment, the field shall be condemned, and the Director shall cause the bulbs to be de stroyed.
Tolerances
9 The maximum percentages of diseased and otherwise undesir able plants acceptable in certified fields of Easter lilies shall be fixed from time to time by the Director and approved by the Minister, and published prior to the 1st day of January in each year.
INSPECTION OF NURSERY STOCK PRIOR TO SHIPMENT
Inspection of bulbs for export
10 All bulbs and other nursery stock to be exported shall be in spected at the time of packing, and Easter lily bulbs shall be packed un der the supervision of Inspectors of the Department, and shall be suit able for shipment with respect to maturity, size, count and freedom from pests and observable diseases.
Production of certificates
11 Certificates of field inspection of Easter lilies shall be presented by the growers to the Inspectors when Easter lily bulbs are delivered at the packing sheds, and no Easter lily bulbs shall be accepted at the packing sheds for which field certificates have not been issued.
Immature bulbs
12 In no case will immature Easter lily bulbs be certified.
Double crowns
13 The percentage of double crowns acceptable in Easter lily bulbs shall be approved by the Minister.
Returns to be furnished
14 On or before the 30th day of September in each year every packer and shipper shall make a proper return on the forms furnished of the number and sizes of all bulbs exported whether grown by him or purchased or shipped on consignment, and in the latter case the names of the growers and their respective quantities of bulbs shall also be given.
Sizing sticks
15 Sizing sticks used in the grading of bulbs shall be inspected, and approved sticks shall be stamped by the Inspector.
SHIPPING CERTIFICATES
Shipping certificates
16 On every shipping certificate and copy thereof shall appear—
(a) the permit number, if required by the importing country;
(b) the examination number;
(c) the date;
(d) the name and address of the exporter;
(e) the name and address of the consignee;
(f) a statement of inspection and freedom from disease;
(g) a statement of inspection of packing material;
(h) the signature of an Inspector (on certificates only);
(i) the nature and quantity of the shipment;
(j) the seal of the Department; and
(k) any other information which the importing country may require.
Inclusion of field certificates
17 In the case of Easter lily bulbs, certificates of field inspection by the Plant Pathologist shall be included in the shipping certificates and copies thereof.
Restriction on export of vegetables and fruits
18 No vegetables and fruits may be exported to the United States of America or to the British West Indies, except the following vegetables and fruits—
(a) root vegetables;
(b) leaf and head vegetables;
(c) corn or maize in the ear;
(d) cucumbers;
(c) melons;
(f) peas;
(g) pumpkins, squashes, and vegetable marrows;
(h) string or French beans; and
(i) tomatoes in an unripened state.
Name of grower may be required to be shown on case
19 The name of the grower shall be placed in or on every case of Easter lily bulbs if the Minister so orders.
Copy certificates
20 A charge of one half cent per case shall be made for each copy certificate issued with respect to all nursery stock not inspected at the Department.
Small quantities of nursery stock to be brought for inspection
21 Small quantities of nursery stock shall be brought to the De partment for inspection.
PACKING MATERIAL AND CONTAINERS
Approval of packing material
22 All nursery stock for export shall be packed in cases and in packing material approved by the Director.
Purity of coral sand
23 Coral sand used for packing shall be uncontaminated by surface soil.
Packing material not to be used again
24 No packing material shall be used which has previously been used as packing for bulbs or other nursery stock.
NOTICE
Sufficient notice
25 Exporters of Easter lily bulbs shall give sufficient notice of their intention to export, shall furnish the information named in regulation 16 of these Regulations and shall afford the duly authorized officers of the Department all reasonable facilities in the discharge of their duties under these Regulations.
EASTER LILY BULBS
Date of first shipment
26 (1) For the convenience of exporters of Easter lily bulbs, the Di rector shall in each year consult with them regarding the date on which the first shipment of bulbs shall be made.
(2) The date decided on by a majority of the shippers shall be made public by notice, and the issue of certificates shall be made ac cordingly.
Bond for export of large shipment
27 Every person or firm who desires to export more than ten cases of Easter lily bulbs in any shipping season shall give a bond in the sum of two thousand four hundred dollars for the proper fulfilment of his obligations as a packer and shipper, including the payment of all amounts owed to any grower for bulbs bought or shipped on consign ment.
Application for licence to ship
28 Application for licences to pack and ship Easter lily bulbs shall be made to the Minister.
Licences
29 (1) The Minister thereof shall deal with all
applications for li cences, and the issue of such licences shall be subject to
the approval
of
the Minister who may revoke any licence at any time if there is evidence of any
breach of the conditions of such licence or if
in its opinion the continuance
of the licence is detrimental to the Easter lily bulb industry:
Provided that in the event of a licence being revoked the licensee may appeal to the Governor, whose decision in the matter shall be final.
(2) The appointment of the Committee and any variation of the membership shall be published in the Gazette.
Signature by Director
30 Licences shall be signed by the Director.
Disclosure
31 The Minister may at any time require any licensed packer and shipper of Easter lily bulbs or his sureties to submit for its information any account, sales or other papers, documents and information relating to the shipment by him of Easter lily bulbs to be sold on consignment for growers.
Publication of list of packers and shippers
32 The Minister shall publish at least twice yearly the names of all licensed packers and shippers of Easter lily bulbs.
Offences
33 Any person who contravenes any provision of these Regulations commits an offence against these Regulations:
Punishment on summary conviction: a fine of $12.
