AUXILIARY BICYCLE LIVERIES (PROTECTIVE
HEADGEAR)
REGULATIONS 1976
[made under section 10A of the Auxiliary Bicycles Act 1954 [title 21 item 7] and brought into operation on 1 January 1977]

Liveries to issue protective headgear
1 (1) The operator of an auxiliary bicycle livery shall, on entering into an agreement with a customer for the hire of an auxiliary bicycle, is sue protective headgear for the use of the customer and, if it is intended under the agreement that another person shall ride the auxiliary bicycle, shall also issue protective headgear for the use of that person.
(2) An operator who fails to comply with paragraph (1) commits an offence.
Sanitation of headgear
2 (1) On the return of protective headgear after use by any per son the operator of an auxiliary bicycle livery, before reissuing the head gear for use by any other person, shall cause it to be sanitated by the following method:—
(a) loose material shall be removed from the internal surface by an instrument applying forced air under a pressure of not less than 50 lbs. per square inch;
(b) the external shell shall be cleaned and disinfected by use of an approved surface cleaner;
(c) the internal lining, if any, shall be cleaned by use of a clean damp cloth bearing an approved cleaning agent;
(d) the internal lining shall be sprayed with an approved disinfecting spray:
Provided that if the Minister is satisfied that protective headgear can be effectively sanitated by an approved alternative method he may by notice in writing authorize an operator to use such method and the use thereof shall be accepted for the purposes of this regulation.
(2) In this regulation "approved" means approved by the Min ister charged with responsibility for health, by notice published in the Gazette.
Sanitation seal to be attached
3 (1) On the sanitation of protective headgear in accordance with regulation 2 the operator of an auxiliary bicycle livery shall cause to be attached to the headgear a seal in a form approved by the Minister indi cating that the headgear has been sanitated in accordance with these Regulations.
(2) An operator who causes or permits a seal to be attached to any headgear which has not been sanitated in accordance with regula tion 2 commits an offence.
Maximum deposit
4 (1) The maximum deposit which may be taken by the operator of an auxiliary bicycle livery for the return of an item of protective head gear issued to a customer shall be $12.00.
(2) An operator who demands or receives a deposit for the re turn of an item of protective headgear in excess of the amount specified in paragraph (1) commits an offence.
Entry on premises to inspect headgear
5 (1) An officer of the Department or any person
duly authorized by the Minister may at any time during business hours enter any
premises which are being used for the operation of an auxiliary bicycle livery
and conduct an inspection for the purpose of ensuring
that pro tective headgear
is being issued and sanitated in accordance with these Regulations.
(2) The operator of an auxiliary bicycle livery or any person employed therein who obstructs any person mentioned in paragraph (1) in the execution of his duty commits an offence.
