BERMUDA AIRPORT REGULATIONS 1959

[made under section 6 of the Civil Airports Act 1949 [title 23 item 1]

Citation

1 These Regulations may be cited as the Bermuda Airport Regula tions 1959.

Interpretation

2 In these Regulations,

"the Act" means the Civil Airports Act, 1949;

"the Airport" means the Bermuda Airport as defined in section 1 of the Act;

"an Airport policeman" means any person appointed by the Board for the purpose of maintaining law and order within the Airport;

"an officer of the Department" means any public officer ap pointed to the Department of Civil Aviation and authorized in writing by the Minister to exercise the powers and duties conferred upon or attaching to such officer under these Reg ulations.

Prohibited acts

3 Any person who, within the Airport,

(a) wilfully obstructs or interferes with the proper use of the Airport;

(b) wilfully obstructs any person in the execution of his duty in relation to the control and management of the Airport;

(c) remains on the Airport after having been requested by an Airport policeman or officer of the Department to leave it or any part of it;

(d) allows any vehicle or equipment to be on the Airport or any part of it having been requested by an Airport po liceman or officer of the Department to remove it or after its presence in that place has been forbidden;

(e) boards or attempts to board any aircraft without the authority of the person in charge of it;

(f) tampers or interferes with any aircraft or anything used in connection with an aircraft;

(g) smokes or otherwise brings or lights any naked light into or in

(i) any place where any such act is prohibited by notice; or

(ii) any place within 50 feet of an aircraft or a store of liquid fuel or explosives;

(h) does any act which causes or is likely to cause an out break of fire;

(i) climbs any wall, fence, barrier, railing or post;

(j) fails to place an aircraft in the place or position ap pointed by an officer of the Department for that purpose;

(k) fails properly to moor or otherwise secure any stationary aircraft or equipment when required to do so by an offi cer of the Department;

(l) collects, disposes of or transfers sewage, trash or garbage in any manner which has not been approved by the Minister;

(m) does any act in the handling of inflammable liquids which is likely to endanger any person or property in the Airport;

(n) fails to maintain properly or use in a safe condition any equipment on the ramp in connection with the servicing, loading or unloading of any aircraft;

(o) does any act in the servicing, loading or unloading of an aircraft which is likely to endanger any person or prop erty in the Airport;

(p) fails to comply with any directions of the Minister relat ing to safety precautions in the carrying out of any oper ation within the Airport which is likely to cause injury or damage to any person or property;

(q) drinks any intoxicating liquor in any place to which the public in ordinary circumstances have access (including any area which is visible from any such place) and which is not a place licensed for the sale of intoxicating liquor—

commits an offence against these Regulations.

Unauthorized acts

4 Any person who, without the authority of an officer of the De partment,

(a) enters or leaves the Airport otherwise than through a gate or entrance for the time being provided for the pur pose;

(b) enters any part of the Airport to which members of the public are not for the time being admitted;

(c) sells or distributes any thing, or offers any thing for sale or hire, or offers to perform services of any kind for pay ment;

(d) exhibits any notice or advertisement except on premises which the person exhibiting it is authorized to occupy and in accordance with the terms of his occupation of the premises;

(e) leaves a vehicle on the Airport longer than is reasonably necessary for the transaction of the business or the pur pose for which it was brought there;

(f) drives a vehicle elsewhere than in a place provided for the passage or accommodation of such a vehicle;

(g) runs an aircraft engine in any place other than one duly authorized for that purpose;

(h) fills or discharges from any container (including any part of a vehicle) liquid fuel otherwise than in a place ap proved for that purpose by the Minister;

(i) stores any inflammable or explosive goods elsewhere than in a place constructed for the purpose and ap proved by the Minister;

(j) lights a fire in a place elsewhere than in a place con structed for the purpose and approved by the Minister,

commits an offence against these Regulations.

Punishment of offenders

5 Where a person commits an offence against these Regulations:

Punishment on summary conviction: a fine of $420 or in respect of a second or subsequent offence imprisonment for 3 months or a fine of $840 or both such imprisonment and fine.

Saving

6 These Regulations shall not apply to any person carrying out any duty under statutory authority and acting within the scope of such au thority in the proper execution of such duty.
