BERMUDA STATUTORY
INSTRUMENT
BERMUDA GOVERNMENT
SCHOLARSHIPS
REGULATIONS 1958
[made under
section 5 of the Bermuda Government Scholarships Act 1958 [title 12 item 2] and
brought into operation on 30 July 1958]

Educational
test
1 (1) The
educational test for the Bermuda Government Scholarships shall, until some
other test is prescribed by regulations made under
the Bermuda Government
Scholarships Act 1958 [title 12 item 2], be—
(a) at least two subjects of the General
Certificate of Education at Advanced Level or an equivalent qualification from
some place other
than the United Kingdom, together with a general record of
academic achievement adequate to meet the requirements of admission to
the
appropriate faculty of the University selected; or
(b) a qualification equivalent to that specified in
sub-paragraph (a) which has been confirmed by a matriculation authority in the
United
Kingdom as satisfying their requirements; or
(c) documentary evidence that the candidate has
successfully completed an associate degree programme at the Bermuda College; or
(d) documentary evidence that the candidate has
successfully completed two years of a post secondary programme which has been
approved
by the Minister for the purposes of this regulation.
(2) Any candidate who produces to the Permanent
Secretary for Education and related matters a certificate or other proof to the
effect
that he or she has passed the test prescribed in paragraph (1) shall be
considered eligible for selection as a scholar, provided
that he or she has
been educated in Bermuda for at least five years and complies with the other
conditions prescribed in the Bermuda
Government Scholarships Act 1958 [title 12 item 2], and in these
Regulations.

2 A scholarship holder shall not, except
in such circumstances as may be approved by the Minister, while he is such
holder, accept
additional funding from any person or body in Bermuda.

Applications
for award of Bermuda Government Scholarships, etc.
3 Every candidate for a Bermuda
Government Scholarship shall, not later than the fifteenth day of April of the
year in which the scholarship
is to be awarded, or such other date as may be
specified by the Permanent Secretary by an advertisement published in the
Gazette,
make written application to that effect to the Permanent Secretary;
and scholarships shall be awarded by the Minister as soon as
is reasonably
practicable after 15 August of that year.

Requirements in respect of applications
4 Every candidate making application
shall attach to his or her application —
(i) a certificate to the effect that he or
she is a Commonwealth citizen:
(ii) a certificate of birth;
(iii) a certificate from the Minister
responsible for Immigration affairs and related matters in the case of a
candidate who was not born
in Bermuda to the effect that at least one of his or
her parents possesses Bermudian status under the Bermuda Immigration and
Protection
Act 1956 [title 5 item 16],
or that at least one of his or her parents possessed at the time of the death
of such parent Bermudian status as aforesaid or
Bermudian domicile under the Im migration
Act 1937;
(iv) a certificate from the headmaster of the
school at which the candidate has been a scholar, or from some other person to
be approved
by the Board of Education, as to the period during which such
candidate has been educated in Bermuda;
(v) a certificate relative to the moral
character and skill in athletic games of the candidate, such certificate to be
signed by the
headmaster of the school at which he or she had been a scholar,
or by his or her tutor if the candidate is receiving private tuition,
or by any
minister of religion, Justice of the Peace or other prominent or well-known
person in the community; and
(vi) a certificate from a registered medical
practi tioner as to the general health and physical con dition of the
candidate.
Payment of
annual value of scholarship
5 (1) The
annual value of the scholarship shall be paid in two instalments, the first such
instalment being two-thirds the annual value
of the scholarship and the second
such instalment being one-third that value.
(2) The first instalment shall be paid to the
scholar as soon as practicable after receipt by the Permanent Secretary of
proof of the
scholar's registration at an educational institution of further
education.
(2A) The second instalment shall be paid to the scholar as soon as practicable after
the start of the second term or semester of the candidate's course of study
upon receipt
by the Permanent Secretary of a certificate from the head of the
educational institution at which the scholar is pursuing his studies
that the
work and conduct of the scholar have been satisfactory, or that he has been
prevented from pursuing his studies by serious
illness or other unavoidable
cause.
(3) Without such certificate as aforesaid the
scholarship shall lapse.
(4) If the educational institution at which the
scholar pursues his or her studies requires payment to be made otherwise than
as pre
scribed above, the Board of Education may sanction the payment of the
value of the scholarship accordingly.

Method of
payment
6 The Board of Education may authorize
the payment of any sums of money due to any scholar under the Bermuda
Government Scholar ships
Act 1958 [title
12 item 2], and under the conditions prescribed by these Regulations, to be
made to a scholar or to his or her order, upon receipt by the
Permanent
Secretary of the certificate specified in regula tion 5.
Suspension of
payment
7 The Board of Education may sanction
the suspension of the studies of the holder of a Bermuda Government Scholarship
for any por
tion of the period of his scholarship for any reason or with any
object ap proved by the Board of Education, and in any such case
a
proportionate part of the annual value of the scholarship for the whole or any
part of any quarter during which such suspension
continues shall be forfeited
and shall be retained in the Consolidated Fund; but in any such case the
scholar may afterwards resume
and continue his or her studies to the end of the
period of his or her scholarship, on such terms as to payment of a
proportionate
part of the annual value of the scholarship for the pe riod
during which his or her studies are so resumed and continued as the
Board of
Education may sanction,
Appeal to
Minister
8 Any scholarship holder, or his parent
or guardian, who is ag grieved by the decision of the Board of Education under
these Regula
tions may appeal against such decision to the Minister responsible
for education and related matters whose decision thereon shall
be final.
