BERMUDA NATIONAL
LIBRARY REGULATIONS 1992
[made under
section 6 of the Bermuda National Library Act 1946
[title 28 item 12] and brought into operation on 24 July 1992]

In exercise of the powers conferred upon the Minister of Com munity and
Cultural Affairs by section 6 of the Bermuda National Library
Act 1946 [title 28 item 12], the following
Regulations are hereby made:—
Citation
1 These Regulations may be cited as the
Bermuda National Library Regu lations 1992.
Interpretation
2 In these Regulations, unless the
context otherwise requires —
"The
Library" means the Bermuda National Library;
"member"
means member of the Library, and "membership" has a corresponding
meaning;
"prescribed"
means prescribed, in accordance with section 9 of the Bermuda National Library
Act 1946 [title 28 item 12], by
regula tions under the Government Fees Act 1965 [title 15 item 18].

Structure of
the Library
3 (1) The
Library consists of an Adult Library, for use, subject to these Regulations, by
persons of sixteen years of age or over, and
a Youth Library, for use by other
persons.
(2) The Adult Library has three establishments,
namely, "the Main Library" in the City of Hamilton, and Branch
Libraries in
the par ishes of Sandys and St. George's.
(3) The Youth Library also has three
establishments, namely, "the Youth Library" in the City of Hamilton,
and Youth sections
in the Branch Libraries in the parishes of Sandys and St.
George's.
Membership of
the Library
4 (1) Subject
to paragraph (4), every person is entitled upon application to be admitted to
membership without payment of a fee.
(2) A person under sixteen may upon application
be admitted to membership if his application is signed by his parent or
guardian —
(a) supporting the application; and
(b) stating the parent or guardian's acceptance of
respon sibility for any loss or damage that the Library may suffer on account
of
any act or omission by the person under sixteen in question.
(3) Notwithstanding regulation 3(1), a person
under sixteen admitted to membership under paragraph (2) of this regulation may
use the
Adult Library, with —
(a) the Library's consent; and
(b) a signed authorization from his parent or
guardian.
(4) Notwithstanding paragraph (1) a person of
whatever age who is not resident in Bermuda may upon application be admitted to
membership
if he pays the prescribed fee.
Refusal,
cancellation and suspension of membership
5 (1) The
Minister may after consulting the Bermuda National Library Committee determine
that a person shall not be admitted to member
ship.
(2) Where a member has contravened regulation
6(2) or any prohibition in a notice made under regulation 10, being a
prohibition applying
to him, the Minister may after consulting the Bermuda
National Library Committee cancel that person's membership or suspend it for
such pe riod as the Minister may deem fit.

Transfer of
membership rights, etc.
6 (1) A
member cannot transfer any of his membership rights to any other person.
(2) A member shall not without the Library's
consent give or lend library material to any other person.
(3) Notwithstanding paragraphs (1) and (2), the
Head Librarian may give permission to any person, known to the Library Staff to
belong
to a member's household, to borrow Library material in that member's
name with the member's consent.
Responsibility
of member for Library material
7 A member remains responsible for
Library material that he has borrowed or otherwise has until it is returned to
the Library.
Fees
8 The prescribed fee shall be paid for
the following matters —
(a) membership by a person who is not resident in
Ber muda;
(b) issue of a replacement Library card;
(c) keeping Library material beyond the time
allowed;
(d) reservation of Library material;
(e) a search by the computerized searching service;
(f) rental or [sic]
audio-visual software, video cassettes, compact discs or other items.
Suspension of
borrowing rights for non-payment of overdue fees
9 A member who is required to pay a fee
by virtue of regulation 8(c) shall not be permitted to use the Library's
circulation service
until the fee is paid.
Head
Librarian's notices
10 (1) The
Head Librarian after consultation with the Minister may from time to time make
and amend as he sees fit administrative notices
providing for the management of
the Library and regulating the conduct of members and others using it.
(2) A notice under paragraph (1) may not be at
variance with anything in these Regulations.
(3) A notice under paragraph (1) shall be
displayed appropri ately on Library premises.
Restrictions on
smoking, eating and drinking
11 A person shall not —
(a) smoke; or
(b) eat or drink,
on Library
premises except in an area appointed by the Head Librarian for that purpose.
Offences
12 A person who contravened regulation 11
is guilty of an offence and liable on summary conviction to a fine of $100.
Revocation
13 The Bermuda Library Regulations 1971
and the Library (Prevention of Parking of Bicycles) Regulations 1943 are revoked.
