CIVIL AIRPORTS (LICENSING OF PRE-ARRANGED TRANS PORTATION SERVICES) REGULATIONS 1980

[made under section 6 of the Civil Airports Act 1949 [title 23 item 1] and brought into operation on 20 June 1980]

Citation

1 These Regulations may be cited as the Civil Airports (Licensing of Pre-arranged Transportation Services) Regulations 1980.

Interpretation

2 In these Regulations —

"airport" means the Bermuda Airport as defined in section l of the Civil Airports Act 1949;

"Director" means the Director of Civil Aviation.

Pre-arranged paid ground transportation licence

3 (1) Anyone who desires to engage in the ground transportation for reward of persons arriving at the airport from outside Bermuda on the basis that arrangements have been made outside Bermuda for pay ment in Bermuda, of the costs of such transportation shall be able to do so only upon the authority of a licence issued by the Director after con sultation with the Public Service Vehicles Licensing Board.

(2) The licence shall be in such form and subject to such con ditions as to the Director may seem appropriate.

Licence

4 A licence Issued under regulation 3 shall be for one of the cate gories of licences listed in column l of the Schedule and shall—

(a) specify the maximum number of passengers to be car ried as appears in column 2 of the Schedule;

(b) be valid for one year;

(c) be renewable;

(d) be subject to an annual fee of $155.00.

Cash bond

5 Before a licence may be issued the applicant shall lodge with the Director a cash bond in the amount set out In Column 3 of the Schedule appropriate to the category of licence in column 1. Such a bond shall be returned to the licensee upon termination of the licence subject to a de duction therefrom of an amount to cover any charges due from the li censee to operators of taxi-cabs or omnibuses who have transported per sons for the licensee.

Licence not transferable

6 A licence issued by virtue of regulation 3 shall not be transfer able.

Conduct of licensee and his agent

7 The licensee and his agents or servants shall, within the precincts of the air terminal, conduct the business of the licensee In a courteous and businesslike manner and shall, at all times, conduct themselves in such a manner as will meet the approval of the Minister.

Refusal of licence; revocation of licence

8 (1) The Director may refuse to grant a licence and may revoke
a licence where the licensee has failed to efficiently conduct the business of transporting persons who have pre-arranged agreements for their transportation from and to the airport and where the Director refuses to grant, or revokes a licence (as the case may be) he shall give reasons for so doing.

(2) Where a licence has been revoked the licensee shall be pre cluded from re-applying for another licence for the space of twelve months from the date of revocation.

Appeals

9 Where the Director—

(a) refuses to grant a licence; or

(b) revokes a licence,

an appeal from such refusal or revocation shall lie to the Minister within 21 days from the date of notification of the refusal or revocation as the case may be, and such appeal shall be in the nature of a rehearing of the application for, or of the circumstances leading to the revocation of, the licence.

Offences

10 Any person who contravenes regulation 3 commits an offence:

Punishment on summary conviction: a fine of $60 for a first offence;

Punishment on summary conviction for a second or subsequent offence: imprisonment for 3 months or a fine of $120 or both such imprisonment and fine.
