Short title
1 This Act may be cited as the Capital Punishment Referendum Act 1989.
Holding of referendum
2 (1) A referendum shall be held on the question whether or not capital punishment for premeditated murder, is favoured in Bermuda.
(2) The question to be asked in the referendum, and the front of the ballot paper to be used for that purpose, shall be in the form set out in the Schedule to this Act.
(3) Those entitled to vote in the referendum shall be the elec tors who, at the date of the holding of the referendum, would be entitled to vote as electors at a parliamentary election in a constituency.
(4) The Premier may by notice published in the Gazette, ap point a day for the holding of the referendum, being a day not earlier than 30 days after the date of the notice.
Application of Parliamentary Election Act 1978
3 For the purposes of a referendum the votes of the electors shall be cast and the proceedings shall be conducted so far as may be as if a referendum were a general election of members of the House of Assembly and the Parliamentary Election Act 1978 [title 2 item 11] and any regula tions in force under that Act, shall be construed accordingly.
Regulations
4 (1) The Minister of Labour and Home Affairs may by regula tions—
(a) make such provision as to the conduct of the referen dum as may appear to him to be expedient;
(b) apply, in relation to the referendum, with such modifi cations, exceptions, omissions and additions as may be specified in the regulations, any provision of the Parlia mentary Election Act 1978 [title 2 item 11] and any reg ulations made under that Act.
(2) Regulations made under subsection (1) shall be subject to the negative resolution procedure.
Expenses
5 Any expenses incurred in carrying this Act into effect shall be defrayed out of money provided by the Legislature.
