Mayor of municipal corporation may appoint Deputy Mayor

1 Notwithstanding anything contained in section 7(5) of the Mu nicipalities Act 1923 [title 4 item 1], the Mayor of either Municipal Corpo ration and his successors in office may appoint at any meeting of the Corporation concerned any Alderman as Deputy Mayor to act as Mayor; and the Alderman so appointed shall hold that office for the remainder of the term of office of the Mayor, unless in the meantime he dies or resigns or becomes incapable from illness or other incapacity of discharging the duties of his office, when the Mayor may in consequence appoint another Alderman as Deputy Mayor in his place.

Duties of Deputy Mayor

2 (1) The Deputy Mayor shall during the absence of the Mayor perform the duties and exercise the powers and authority of the Mayor and every act done and proceeding taken in or by the Corporation when the Deputy Mayor is acting as Mayor under the authority of this Act shall be as valid and effectual as if the Mayor himself were acting; and
every such act or proceeding done or taken by the Corporation and every deed, instrument or other document signed and executed by the Deputy Mayor while acting as Mayor as aforesaid shall have the same force, effect and validity as if the same had been done or signed or executed by the Mayor himself.

(2) In this section "absence" means the actual absence of the Mayor from Bermuda or his inability from illness, incapacity or other reason to discharge for the time being the duties of his office, and in cludes the absence of the Mayor from any meeting of the Corporation or any part of any such meeting.

Resumption by Mayor

3 If at any meeting of the Corporation at which the Deputy Mayor has assumed the duties of the Mayor in consequence of the absence of the Mayor from such meeting, the Mayor is afterwards present at such meeting, he shall forthwith resume his duties as Mayor.

Saving if Deputy Mayor not appointed or absent

4 If from any cause whatsoever either Mayor does not appoint a Deputy Mayor or if a Deputy Mayor appointed as aforesaid is absent within the meaning of section 2, then section 7(5), (6) and (7) of the Mu nicipalities Act 1923, shall apply and have the same force and effect in relation to the Corporation concerned as if this Act had not come into force.

Deputy Mayor retains status as Alderman

5 Any Deputy Mayor acting as Mayor at any meeting of the Corpo ration shall not by reason of his so acting be deprived of his status and vote as Alderman.
