Fisheries (Protected Areas) Order 1990

BERMUDA STATUTORY INSTRUMENT

BR 17/1990

FISHERIES (PROTECTED AREAS) ORDER 1990

[made under section 4 of the Fisheries Act 1972 [title 25 item 8] and brought into operation on 30 March 1990]

Citation

1 This Order may be cited as the Fisheries (Protected Areas) Order 1990.

Protected areas

2 The following areas:

(a) "South West Breaker Area" being that area within a 600 metre radius of a mooring buoy located at 32o 13.8'N, 64o 51.8'W at South West Breaker;

(b) "Constellation Area" being that area within a 500 metre radius of a mooring buoy located at 32o 21.8'N,[64] 54.8'W at the wreck of the "Constellation";

(c) "Eastern Blue Cut" being that area within a 600 metre radius of a mooring buoy located at 32o 23.4'N, 64o 53.1'W at Eastern Blue Cut';

(d) "Pelinaion" and "Rita Zovetta" being that area within a 500 metre radius of a mooring buoy located at 32o 21.3'N, 64o 38.4'W at the wrecks of the vessels "Pelinaion" and "Rita Zovetta";

(e) "Hermes" and "Minnie Bressleur" being that area within a 500 metre radius of a mooring buoy located at 32o 14.4'N, 64o 47.4'W at the wrecks of the vessels "Hermes" and "Minnie Bressleur";

(f) "Kate" being that area within a 300 metre radius of a mooring buoy located at 32o 19.4'N, 64o 41.7'W at the wreck of the vessel "Kate";

(g) "Vixen" being that area within a 100 metre radius of the wreck of the vessel "Vixen", located 300 metres west of Daniel's Head;

(h) "North Rock Area" being that area within a 100 metre radius of North Rock beacon located at co-ordinates 32o 28.45'N, 64o 46.05'W at North Rock;

(i) "Xing Da Area" being that area within a 200 metre radius of a mooring buoy located at 32o 25.027' N, 64o 54.375' W at the wreck of the vessel "Xing Da";

(j) "South Western Area" being the area enclosed: on the Northern margin by a line originating at Gibbs Hill Light, running on a bearing of 276 degrees true to the 100 fathom contour (Gibbs Hill Light in line with the tripod at the southern end of the Western Boat Chan nel); on the South Eastern margin by a line originating at Gibbs Hill Light and running on a bearing of 235 de grees true to the 100 fathom contour (Gibbs Hill Light in line with South West Breaker); and, on the Seaward margin by the 100 fathom contour;

(k) "Eastern Area" being the area enclosed: on the North west margin by a line originating at St. David's Light and running on a bearing of 036 degrees true to the 100 fathom contour; on the Southeast margin by a line originating at St. David's Light and running on a bear ing of 065 degrees true to the 100 fathom contour; and, on the Seaward margin by the 100 fathom contour;

(l) "North Eastern Area" being the area enclosed: On the Western margin by a line originating at the Southwest corner (SWC) located seven nautical miles due north of St. David's light at co-ordinates 32 degrees 28.5 min utes North, 64 degrees 39.0 minutes West; running due North to the 100 fathom contour; on the Southern mar gin by a line originating at SWC, running on a bearing of 087 degrees true to the 100 fathom contour (North Rock Beacon in line of sight with Northeast Breaker Beacon); and, on the Seaward margin by the 100 fathom contour; and

(m) "Commissioner's Point Area" being the area within a 200 metre radius of a stake located at 32 19.72'N, 64 49.93'W and bounded on the south-west and south-east by the shore,

are declared to be protected areas for the purpose of the Act.

Prohibitions

3 The taking of any fish and the anchoring of any vessel—

(a) at any time, within the protected areas specified in paragraph 2(a) to (i) (inclusive); or

(b) during the period beginning on 1 May and continuing until and throughout 31 August in any year, within the protected areas specified in paragraph 2(j) to (m) (inclusive),

is prohibited.

Revocations

4 The Fisheries (Protected Area) Order 1973, the Fisheries (Protected Areas) Order 1976 and the Fisheries (Protected Areas) order 1989 are revoked.
