BERMUDA STATUTORY INSTRUMENT

FUGITIVE OFFENDERS (UNITED KINGDOM DEPENDENCIES) ORDER 1969

[made by the Governor under the Fugitive Offenders Act 1967 of the United Kingdom as applied to Bermuda [title 8 item 38] and brought into operation on 15 October 1969]

Interpretation

1 In this Order the Fugitive Offenders Act 1967, means the Act of the Parliament of the United Kingdom entitled the Fugitive Offenders Act 1967 modified and adapted as in the Schedule to the Order of Her Majesty-in-Council entitled the Fugitive Offenders (Bermuda) Order, 1967 [title 8 item 38] as amended by the Orders of Her Majesty-in-Coun cil severally entitled the Fugitive Offenders (Overseas Territories) Order, 1968, the Fugitive Offenders (Overseas Territories) (No. 2) Order, 1968 and the Fugitive Offenders (Bermuda) (Amendment) Order, 1968.

Countries designated

2 Section 2(2) of the Fugitive Offenders Act 1967 (which defines "United Kingdom dependency") shall apply to the countries specified in the Schedule hereto (being countries outside Her Majesty's dominions in which Her Majesty has jurisdiction, or over which she extends protec tion, in right of Her Government of the United Kingdom).

New Hebrides

3 In relation to the return of persons to the New Hebrides, the Fugitive Offenders Act 1967 shall have effect as if at the end of section 3 (1) thereof (which defines a relevant offence for the purposes of the Act) there were added the following proviso—

"Provided that an offence of which a person is accused or has been convicted in the New Hebrides shall not be a relevant offence unless he is liable to be tried therefor, or, as the case may be, has been con victed thereof, by the High Court of the Western Pacific or by the joint Court established for the New Hebrides".
