SCHEDULE
Interpretation
1 In these Regulations—
(a) "function" has the meaning assigned
to it in the Gov ernment Fees Act 1965 [title
15 item 18];
(b) any reference to a provision of law under which
a func tion is performed shall include a reference to any statu tory instrument
having effect under that provision of law;
(c) any reference to a section without mention of
an Act is a reference to the section of the Act under which the rele vant
function
is performed;
(d) any reference to a search of any record-books
main tained by a public officer is a reference to a search bona fide conducted
for
one document only, or as respects a search in any register or index,
otherwise than for trac ing any particular document, is a reference
to a search
bona fide conducted for one entry only.
Schedule of
fees payable
2 (1) In
respect of each of the functions specified in a Head in the Schedule (being
functions performed under the provision of law set
out immediately following
the number of that Head) there shall be paid a fee as set out in that Head in
relation to such function.
(2) Any fee payable under paragraph (1) shall be
payable to the public authority performing the function, unless the payment of
the
fee is regulated by paragraph (3).
(3) Where the Accountant General by notice
published in the Gazette directs that a fee shall be payable to him, the fee
shall be payable
to the Accountant General in accordance with the notice and
not any longer to the public authority performing the function.

such a person with an existing work permit to another employer where the
duties remain the same |

(ii) to transfer
such a person from one occupation to another occupation with the same em ployer |
|
|
(iii) to change the
job title of such a person whose employer and duties remain the same |
|
|
(5) Applying
for a work permit, valid for such period as may be specified in the permit,
to employ a person without Bermudian status
who states in writing that he or
she — |
|
|
(a) does not possess Bermudian status and is a
child, under the age of 22 years, of a person who does possess Bermudian
status;
or |
|
|
(b) is the parent or lawful guardian of, and has
legal custody of, a person with Bermudian status who is under 21 years of age
and
resides with him or her; or |
|
|
(c) was born in Bermuda and can potentially
qualify for the grant of Bermudian status under section 20A; or |
|
|
(d) first arrived in Bermuda before his or her sixth
birthday and can potentially qualify for the grant of Bermudian status under
section 20A |
|
|
(6) Where
a permission is granted for a pe riod less than that applied for, the
relevant pro portion of the fee paid in accordance
with categories (viii) to
(xi) of paragraph (4)(a), shall be refunded. Where no permission of any kind
is granted, then the
fee paid under categories (iii) to (v) and (vii) to (xi)
of paragraph (4)(a), less $105, shall be refunded. |
|
|
(7) Where
a permission is granted in accor dance with categories (viii) to (xi) of
paragraph (4)(a) above and the work permit is
cancelled before the expiry
date, there shall be refunded the relevant fee for each whole year that
remains unused on the date
of cancellation. |
|
|
(8) Considering
an application by a restricted person or a trustee or grantee for the benefit
of a restricted person for a licence
to hold or acquire land |
|
|
(Where a licence is issued under paragraph (9)
the fee specified in this paragraph shall be refunded to the applicant.) (9) Issuing
to a restricted person or to a trustee or grantee for the benefit of a

(5) In all cases where the building
operations commence prior to the issue of the required permits listed above, an
additional fee of
$300 will be charged.
(6) Under this item —
For the purposes of calculating the
building permit fee in accordance with paragraphs (1)(a)(i) and (2)(a)(i), the
floorspace to
which the fee shall apply means the total square footage of new
construction, including verandas and balconies, but excluding outdoor
paved
areas, patios and the like;
"accessory structures"
include, but are not limited to, tennis courts, parking areas, driveways,
docks, walls, satellite
dish receivers, signs, piers, platforms, patios and like
structures which do not result in the creation of additional, enclosed
floorspace, that are incidental to the principal building and located on the
same lot; and, for the avoidance of doubt, a swimming
pool is not an accessory
structure and any separate application for a pool shall be subject to the
minimum fee set out in either
paragraph (1)(a)(i) or (2)(a)(i), whichever is
applicable;
"re-inspection of works"
means a re-inspection made necessary because, at a previous, scheduled visit to
the works, either—
(a) conditions at
the works prevented proper access to the works; or
(b) the works did
not meet the requirements of the Bermuda Building Code; or
(c) the works for
some other reason were not available or ready for inspection; or
(d) a copy of the
approved drawings was not available on-site.
Provided
that, in the case of an existing building where the application relates to
building works designed specifically to provide
access for, or otherwise meet
the needs of, the physically handicapped, no fee shall be charged; and
Provided
that, in the case of alterations or extensions to a building listed as a
building of special architectural or historical
interest in accordance with
section 30 of the Development and Planning Act 1974, no fee shall be charged.

submission of an application for the renewal of planning permission in
accordance with rule 9 of the Development and Planning
