WHEREAS the Corporation of Hamilton (in this Act called "the Corporation") have presented a petition to the Legislature setting forth that they are desirous of extending the limits of the City of Hamilton westward to the extent set forth in the petition:

AND WHEREAS the petition was considered by the joint Com mittee of both Houses on Private Bills which made a report thereon:

AND WHEREAS pursuant to the tenor of the report the Corpora tion presented a second petition to the Legislature praying that the limits of the City of Hamilton be further extended as set forth in the second pe tition, and it is deemed expedient to pass an Act for the purposes set forth in both petitions:

Extension of limits

1 The land delineated and outlined in red on the plans annexed to the first and second petitions of the Corporation praying for extensions to the city limits amounting to 26.202 acres and 0.687 acres respectively shall, to all intents and purposes, be included within the limits of the City of Hamilton in like manner as if the land had originally been in cluded within the limits of the City of Hamilton and shall be entitled to all the franchises and privileges which other land within the City of Hamilton now enjoys and shall be subject to all such rates, taxes and other assessments as are applicable to such other land within the City of Hamilton.

Evidence of municipal boundaries; deposit of map

2 By 16 August 1951 the Corporation shall deposit in the Registry, for public information and reference, a map or plan of the entire munici pal area of the City of Hamilton, including the land added to the City of Hamilton by section 1, certified under the hand of the Mayor and the Seal of the Corporation to be correct and such map shall be prima facie evidence in all courts as to the extent, position and boundaries of the municipal limits.

Control of roads; application of Ordinances

3 (1) The control of all roads included in such extension of the city limits shall be vested in the Corporation and all maintenance, re pairs and lighting of such roads shall be the responsibility of the Corpo ration.

(2) All present and future applicable Ordinances made by the Corporation under the authority of the Municipalities Act 1923 [title 4 item 1], and the Road Traffic Act 1947 [title 21 item 3], shall apply to the roads included in such exten sion in the same manner as other roads under the control of the City of Hamilton.

(3) In like manner all present and future applicable Ordinances made by the Corporation under the authority of the Public Health Act 1949 [title 11 item 1], shall apply to all land included in such extension.

Saving for title to railway path

4 Nothing in this Act contained shall be construed to affect the ti tle or control of the land over which the railway formerly ran.

Par-la-Ville Park dedicated for use as public park, library and cul-
tural centre

5 The land and premises known as Par-la-Ville Park together with the building thereon shall remain dedicated for use as a public park, li brary and cultural centre and shall so remain until altered by the Legis lature.

Saving for Crown and others

6 Nothing in this Act shall affect the rights of Her Majesty, Her heirs and successors or any body politic or corporate or of any other per son or persons except such as are mentioned in this Act, and those claiming by, from or under them.
