Marine and Ports Authority (Port Dues) Regulations 1969

MARINE & PORTS AUTHORITY (PORT DUES)
REGULATIONS 1969

[made under section 76 of the Marine Board Act 1962 [title 22 item 3] and brought into operation on 1 September 1969]

Liability

1 Port dues shall be payable pursuant to these Regulations in re spect of every ship, other than a ship referred to in section 25(2) of the Marine Board Act 1962, within the territorial waters of Bermuda lying moored, or at anchor, or at any dock or shore.

Rate

2 (1) Port dues payable pursuant to these Regulations in respect of any ship shall be at the rate of four hundred and twenty dollars up to 100 metres length overall and eight dollars and ninety cents per metre or part thereof in excess of 100 metres as stated hereunder —

(a) subject to paragraph (2A) the port dues payable on a ship at anchor or at a moor ing buoy or at the Esso Oil Terminal shall be at the above rate for each day or part thereof:

(b) the port dues payable on a ship at any dock owned by the Government or a municipality shall be at the above rate for each visit; and

(c) the port dues payable in respect of any vessel shall not be less than $375.

(2) For the purposes of these Regulations a day shall be reck oned as a period of 24 hours calculated from the time the ship has com pleted anchoring, mooring or berthing alongside.

(2A) Notwithstanding paragraph (1)—

(a) after any twenty-four hour period has been completed, port dues in respect of a further twenty-four hour period shall not be charged unless a two-hour excess period has been exceeded; and

(b) where full port dues have been paid for ten consecutive days, the Authority may, if it considers it appropriate so to do, reduce further port dues by an amount not exceeding ten per centum of the amount which but for this provision would be chargeable.

Payment

3 (1) The port dues payable pursuant to these Regulations shall be paid by the owner, master or agent of the ship on demand of the Di rector of Marine and Ports Services or of any person authorized by him in writing to receive the same.

(2) The port dues payable pursuant to these Regulations for each day or part of a day or visit, as the case may be, shall, if so de manded as hereinbefore provided, be payable during the day or part of a day on which the demand is made.
