Interpretation

1 In these Regulations, unless the context otherwise requires—

"boat" means any steamboat, motor boat or sailboat not ordinar ily employed in voyages to any port outside Bermuda;

"ship" means any sea-going steamer, motor ship or sailing ship ordinarily employed in voyages beyond the territorial waters of Bermuda.

Right of way in territorial waters

2 Every ship under way in the territorial waters of Bermuda shall have the absolute right of way over any boat.

Duty to keep clear of ships

3 The pilot or other person in charge of any boat shall—

(a) keep such boat at a safe and sufficient distance from any ship under way in the territorial waters of Bermuda;

(b) at no time permit or allow such boat to cross the bow of any such ship within a distance of 300 feet therefrom; and

(c) at no time permit or allow such boat to come within a distance of 100 feet from such ship.

Duty to proceed at reasonable speed and keep clear of other boats

4 The pilot or other person in charge of any boat shall—

(a) navigate such boat when under way in the territorial waters of Bermuda at a reasonable rate of speed; and

(b) keep such boat at a safe and sufficient distance from any other boat under way in the territorial waters of Bermuda.

Penalties

5 Any pilot or other person in charge of any boat who contravenes these Regulations commits an offence:

Punishment on summary conviction: imprisonment for 3 months or a fine of $360 or both such imprisonment and fine.
