MERCHANT SHIPPING (CARRIAGE OF NAUTICAL
PUBLICA TIONS) RULES 1980

[made under section 75 of the Merchant Shipping Act 1979 [title 31 item 16] and brought into operation on 1 April 1980]

SCHEDULE


Citation

1 These Regulations [sic] may be cited as the Merchant Shipping (Carriage of Nautical Publications) Rules 1980.

Exemption of ships under 12 metres in length and fishing vessels

2 These Rules apply to all ships registered in Bermuda other than—

(a) those which are less than 12 metres in length; and

(b) fishing vessels.

Charts specified

3 The Minister hereby specifies the charts described in rule 4 and the directions and information mentioned in rule 5, as the charts, direc tions and information which appear to him necessary or expedient for the safe operation of ships to which these Rules apply.

Description of charts

4 The said charts are those—

(a) which are of such a scale and which contain sufficient detail as clearly to show—

(i) all navigational marks which may be used by a ship when navigating the waters which are com prised in the chart;

(ii) all known dangers affecting those waters; and

(iii) information concerning any traffic separation schemes, two-way routes, recommended tracks, inshore traffic zones and deep water routes ap plicable to those waters and areas therein which are to be avoided;

(b) which are either published by the Hydrographer of the Navy or, if not so published, are of a similar scale to those so published and contain equivalent detail; and

(c) which, in all cases, are of the latest obtainable edition and —

(i) in the case of charts published by the Hydrogra pher of the Navy have been corrected and kept up to date from the latest relevant obtainable Notices to Mariners and Radio Navigational Warnings; and

(ii) in the case of charts not so published, have been otherwise adequately corrected and kept up to date.

In paragraph (b) the reference to the Hydrographer of the Navy Includes a reference to any authority in any country other than the United King dom duly exercising functions similar to those of the Hydrographer.

Directions information and publications

5 The said directions and information are such as are contained in the publications mentioned in column l of the Schedule to these
Rules, being publications which, in all cases, are of the latest obtainable edition and which incorporate the latest relevant supplements and, in the case of any such publication which is published otherwise than by the pub lisher specified opposite thereto in column 2 of the said Schedule, is of equivalent standard and content.

Ship to carry copy of chart

6 Every ship to which these Rules apply which goes to sea or at tempts to go to sea shall carry at least —

(a) one copy of a chart which complies with the require ments specified in rule 4 being a chart which is appro priate for each part of the Intended voyage; and

(b) except in the case of a ship which does not intend to go to sea beyond a distance of 5 nautical miles from any coastline, one copy of each of the publications men tioned in column l of the Schedule to these Rules, with English language text, as Is appropriate for that voyage.
