OBSCENE PUBLICATIONS (CLASSIFICATION AND RESTRICTIONS AS TO SALE) REGULATIONS 1981

[made under section 10(2) of the Obscene Publications Act 1973 [title 10 item 12] and brought into operation on 18 December 1981]

SCHEDULE

Citation

1 These Regulations may be cited as the Obscene Publications (Classification and Restrictions as to Sale) Regulations 1981.

Salacious magazines

2 The magazines specified in the Schedule are classified as magazines containing salacious material.

Restrictions

3 (1) No person shall sell or offer for sale to the public any magazine classified under regulation 2 as containing salacious material and specified in the Schedule unless it is displayed for sale—

(a) not less than six feet from the floor of the premises;

(b) in such a manner that only the title of the magazine may be read;

(c) in such a manner so as to prevent potential customers from looking or leafing through the magazine.

(2) Any person who contravenes paragraph (1) of this regulation commits an offence:

Punishment on summary conviction: imprisonment for 3 months or a fine of $250 or both such imprisonment and fine.
