TOBACCO PRODUCTS (PUBLIC HEALTH) REGULATIONS 1988

[made under section 11 of the Tobacco Products (Public Health) Act 1987 [title 11 item 10] and brought into operation on 1 April 1988]

SCHEDULE

Citation

1 These regulations may be cited as the Tobacco Products (Public Health) Regulations 1988.

Interpretation

2 In these regulations, "the Act" means the Tobacco Products (Public Health) Act 1987 [title 11 item 10].

Cigarette packets

3 The health warning which is required to be borne on packets of cigarettes under section 3 of the Act shall be the health warning required to be placed on the packets by—

(a) the country of origin of the cigarettes for the consump tion therein of the cigarettes; or

(b) the country from which the cigarettes are exported.

Tobacco or tobacco products

4 The health warning which is required to be borne on packets or containers of tobacco or tobacco products under section 4 of the Act shall be the health warning required to be placed on the packets or con tainers by—

(a) the country of origin of the tobacco or tobacco products for consumption therein of the tobacco or tobacco prod ucts; or

(b) the country from which the tobacco or tobacco products are exported.

Cigarette and tobacco product advertising

5 (1) This regulation shall apply to any advertisement which is required to carry a health warning under Part III of the Act.

(2) The health warning shall be as set out in the Schedule.

(3) Where both a health warning and a statement as to the content or the amount of tar in the cigarettes or in the tobacco or the to bacco product advertised appears, they shall be in words and characters of the same size and style.

Health warnings in advertisements—

The standard health warning shall be "HEALTH WARNING. SMOKING IS HAZARDOUS TO YOUR HEALTH".
