UNITED STATES BASES (PRIVATE LEASES) ACT 1942

ARRANGEMENT OF SECTIONS


1 Interpretation


2 Power of Governor to sanction tenancies

Interpretation

1 In this Act—

"tenancy" means a tenancy of land under any lease or letting agreement;

"short tenancy" means a tenancy granted—

(i) for the duration of the war; or

(ii) for a term of ten years or less without any option of renewal which would enable the tenant to prolong the term beyond ten years;

"the United States Bases" means any of the Bases which have been or are being established in Bermuda in pursuance of the Agreement, signed on the twenty-seventh day of March, 1941, between the Governments of the United Kingdom and the United States of America relating to the lease of Bases to the United States of America in certain territories, including Bermuda.

Power of Governor to sanction tenancies

2 The Governor, if he is satisfied that the tenancy is for purposes connected with the United States Bases and if he sees fit—

(a) may sanction the grant to the Government of the United States of America of any short tenancy and may validate and confirm any short tenancy granted to the said Gov ernment before 3 July 1942; and

(b) subject as hereinafter provided, may sanction the grant of any tenancy to the Government of the United States of America where the tenancy is granted for a term of ten years or less but contains an option of renewal which would enable the said Government to prolong the term beyond ten years and may confirm and validate any such tenancy granted to the said Government before 3 July 1942:

Provided that any sanction, confirmation or validation given or declared by the Governor under this paragraph shall cease to have effect if and as soon as the Government of the United States of America have continuously held the land which is the subject of the tenancy for a term amounting, with renewals, if any, to ten years.
