Avertment by competent authority sufficient proof.

Powers of Minister to make orders.

10. In any proceedings under these Regulations an averment in the information that the competent authority is not satisfied as to any matter shall be sufficient evidence that he has not been satisfied until the contrary is proved.

11. (1) The Minister may by Order make such provisions as he thinks expedient for prohibiting or regulating, in all cases or any specified classes of cases, and subject to such exception, if any, as may be made by or under the Order, the exportation from The Bahamas, or the carriage coastwise or the shipment as ship’s stores of all goods and articles.

(2) The Minister may by Order exempt any goods or class of goods from the provisions of these Regulations.

EXPORT CONTROL (No. 1) REGULATIONS

(SECTION 3)

[Commencement 5th January, 1965]

1. These Regulations may be cited as the Export

Control (No. 1) Regulations.

2. In these Regulations, unless the context otherwise requires —

“Act” means the Export Control Regulations Act; “competent authority” means the competent author-
ity appointed under section 4 of the Act;
“specified goods” means the goods listed in theSche- dule to these Regulations.

3. Except under and in accordance with a written licence from the competent authority, no person shall either —

(a) export any specified goods from The Bahamas to any place outside; or
(b) tranship any specified goods within The Baha- mas which are consigned to a place outside The Bahamas.

4. It shall be the duty of any person having in his possession or under his control any specified goods forthwith to notify the competent authority whenever such

specified goods are delivered by him or by his order to any other person within The Bahamas in such circumstances as may lead to the supposition that such specified goods are about to be or may be exported from The Bahamas.

5. It shall be lawful for the competent authority by notice in writing to require any person in whose possession or under whose control there may be specified goods at any time to furnish him in writing with such details as he may require regarding the nature, extent, value and whereabouts of such specified goods.

6. (1) Any person who fails to comply with or contravenes any of the provisions of these Regulations shall be liable —

(a) on summary conviction to imprisonment for six months or to a fine of four hundred dollars or to both such imprisonment and fine; or
(b) on conviction by the Supreme Court to imprisonment for three years or to a fine of two thousand dollars or to both such imprisonment and fine.
(2) When any person is convicted of an offence under the provisions of paragraph (1) of this regulation the court shall order that any specified goods in relation to which such offence has been committed and which are in the possession or under the control of any person so convicted shall be forfeited to the Government.

SCHEDULE (Regulation 2) SPECIFIED GOODS

1. Coins wherever minted before the year A.D. 1800 of gold or silver or of any alloy containing gold or silver.

2. Any article other than coins fashioned before the year A.D.

1800 from gold or silver or any alloy containing gold or silver.

3. Any gold or silver or any alloy containing gold or silver in bulk or bullion obtained by melting down or otherwise treating or dealing with any specified goods within The Bahamas.

4. Any article fashioned in The Bahamas from gold or silver or any alloy containing gold or silver and obtained by melting down or otherwise treating or dealing with any specified goods within The Bahamas.
