THE MERCHANT SHIPPING ACT

(Chapter 268)

THE MERCHANT SHIPPING

(AMENDMENT FEES) ORDER, 2005

The Minister of Transport and Aviation, in exercise of the powers conferred by her under sections 18 and 293 of the Merchant Shipping Act, (Chapter 246), as amended hereby varies the fees as follows.

1.(1)
This Order, which amends the Merchant Shipping Order maybe cited as the Merchant Shipping (Amended Fees) Order.

Citation and commencement.

(2)
This Order shall come into operation on 1st January, 2006.

In this Order, unless the context otherwise requires -

Interpretation.

"net Tonnage" means the net tonnage ascertained in accordance with the provisions of the Merchant Shipping (Tonnage) Regulations 1982 and is shown or to be shown as the net Tonnage of the ship in the Certificate of Registry of the relevant ship.

Notwithstanding the fees specified in any of the existing regulations, the following amended fees shall be applicable:

Amended Fees.

(i)
The following annual fees shall apply:
(a)
for ships of 2,000 net tonnage or less $2552.00;
(b)
for ships of not less than 2,001 net tonnage but not more than 5,000 net tonnage $2090.00 plus $0.20 per register ton;
(c)
for ships of not less than 5,001 net tonnage $2090.00 plus $0.17 per register ton;
(ii)
The following annual fees shall apply in respect of home trade ships and ships not engaged in commercial trade:
(a)
home trade ship of 2,000 net tonnage or less the annual fee shall be $725.00;
(b)
home trade ship of not less than 2,001 net tonnage the annual fee shall be $600.00 plus $0.13 per net ton;
(c)
ship not engaged in commercial trade the annual fee shall be $700.00.

(iii)

Issue of a Certificate or Endorsement for a seafarer

$90.00

(iv)

Renewal of a Certificate or Endorsement issued to

a seafarer

$90.00

(v)

Issue of a "Seaman's Record Book" for a seafarer

$50.00

(vi)

Issue of Safe Manning Document (to a ship)

$150.00

(vii)

Permit to Operate for a High Speed Craft

$300.00

(viii)

Registration of transfer of ownership by bill of sale or Transmission, or of mortgage or transfer, Discharge of a mortgage of a ship therein where the ship does not exceed 1,600 net registered tons

$200.00

& where the ship exceeds 1,600 net registered tons

$400.00

(ix)

Issue of a "Deletion Certificate"

$500.00

(x)

Issue of a Letter of consent for bare-boat charter

$150.00

(xi)

Issue of an Exemption

$100.00

(xii)

Services rendered for which no specific fee is stipulated per hour of the work ;

$90.00

(xiii)

Inspection by an Inspector (an officer of the BMA) to release a ship from detention (after carrying out necessary repairs/rectification of deficiencies for which ship was originally detained)

$90.00

per hour of work and travel and accommodation expenses where applicable ;

(xiv)

Inspection and assessment for approval of training course or centre - Actual cost relating to travel, accommodation and assessment time at the rate of

$90.00

per hour to he recovered ;

(xv)

Issue of copy of a certificate/document/letter - same as specified for issue of the original certificate/document/letter.

4.
Any Fees, specified in any of the existing Order, which have been affected by this Order, shall stand void.

Revoke.
