THE MERCHANT SHIPPING ACT

THE MERCHANT SHIPPING

(VARIATION OF REGISTRATION AND

ANNUAL FEES) (AMENDMENT) ORDER, 2002

The Minister, in exercise of the powers conferred by section 18(3) of the Merchant Shipping Act, makes the following Order -

1.(1)
This Order, which amends the Merchant Shipping (Variation of Registration and Annual Fees) Order, 1998 may be cited as the Merchant Shipping (Variation of Registration and Annual Fees) (Amendment) Order, 2002.

Citation and commencement.

Paragraph 3 of this Order shall be deemed to have come into force on the 1st` day of January, 2002.

Paragraph 4 of the principal Order, 1998 is amended -

Amendment of paragraph 4 of the principal Order.

(a)
in subparagraphs (3) and (4), by the insertion of the words "but less than twenty ships" immediately following the words "Where ten or more ships";
(b)
by the deletion of subparagraphs (5) and (6) and the substitution therefor of the following -
"(5)Where twenty or more ships in the same ownership are registered at the same tie the registration fee as calculated under subparagraph (1) shall be reduced by sixty per centum provided that the completion of the first construction of all such ships occurred not more than twelve years before the date of registration of the ships.
(6)Where twenty or more ships in the same ownership are registered at the same time and where the net tonnage of the ships is more than 200,000 net tonnage the registration fee as calculated under subparagraph (1) shall be reduced by sixty per centum provided that an initial inspection has been satisfactorily completed on all the ships."; and
(c)
by the insertion immediately following subparagraph (7) of the following new subparagraphs -
"(8)Notwithstanding paragraph 3(2) and paragraphs 4(1) to (6), no reduction shall be made in respect of a vessel of less than 500 net tonnage.
(9)Where a registration fee bas been reduced under any one of subparagraphs (1) to (6) it shall not be further reduced under the terms of any other paragraph.".

Paragraph 5 of the principal Order is revoked and replaced as follows -

Revokes and replaces paragraph 5 of the principal Order.

"Annual fees.

5.(1) For the annual fees prescribed in section 18(2) of the Act there shall be substituted the following -

(a)
for ships of 2,000 net tonnage or less $2,100;
(b)
for ships of not less than 2,001 net tonnage but not more than 5,000 net tonnage $1,750 plus $0.16 per registered ton; and
(c)
for ships of not less than 5,00 net tonnage $1,750 plus $0.13 per registered ton.
(2)For the annual fees prescribed in section 18(3) of the Act in respect of home trade ships and ships not engaged in commercial trade, there shall be substituted the following -
(a)
in respect of a ship of 2,000 net tonnage or less the annual fee shall be $660;
(b)
in respect of a ship of not less than 2,001 net tonnage but not more than 5,000 net tonnage the annual fee shall be $500 plus $0.13 per net ton;
(c)
in respect of a ship of not less than 5,001 net tonnage the annual fee shall be $500 plus $0.12 per net ton; and
(d)
in respect of a ship not engaged in commercial trade the annual fee shall be $350.".
