AGREEMENT BETWEEN THE UNITED KINGDOM AND THE LATVIAN REPUBLIC RELATING TO TONNAGE MEASUREMENT CERTIFICATES

His Britannic Majesty's Governments in Great Britain, Canada, the Commonwealth of Australia, New Zealand, the Union of South Africa and the Irish Free State and the Government of India, on the one part, and the Government of the Latvian Republic, on the other part, have agreed as follows:


1. In view of the fact that the existing laws and regulations in the territories of His Britannic Majesty in regard to measurement of tonnage of merchant ships are in substantial agreement with those of Latvia, British ships furnished with certificates of registry and other national papers duly issued by the competent British authorities shall be deemed by the Latvian authorities to be of the tonnage denoted in the said documents, and shall be exempted from being remeasured in any port or place within Latvian territory or in localities under the control of Latvia, on condition that similar terms shall be accorded to Latvian ships equipped with certificates of registry or other national papers duly issued by the competent Latvian authorities on or after the 4th June, 1925, and that such ships shall be exempted from being remeasured in any place under His Britannic Majesty's sovereignty, authority or jurisdiction.

2. The Government of the Latvian Republic on the one part may by a twelve months' notice in writing addressed to His Britannic Majesty's representative at Riga terminate this agreement either collectively with all or separately with some or any of His Britannic Majesty's Governments enumerated above, including the Government of India.

3. His Britannic Majesty's Governments enumerated above, including the Government of India, may terminate this agreement either collectively, or some or any of them separately, be a twelve months' notice in writing addressed to the Government of the Latvian Republic by His Britannic Majesty's representative at Riga.

4. Subject to the provisions of paragraph 6 of this agreement, in the event of this agreement being separately terminated by or with his Britannic Majesty's Government in Great Britain, it shall cease to apply to all territories under the sovereignty, authority, or jurisdiction of his Britannic Majesty other than Canada, the Commonwealth of Australia (including Papua, Norfolk Island, New Guinea and Nauru), New Zealand (including Western Samoa), the Union of South Africa (including South-West Africa), the Irish Free State and India, and all British ships other than those registered in the territories to which the agreement continues to apply.

5. In the event of this agreement being separately terminated by or with His Britannic Majesty's Governments in Canada, the Commonwealth of Australia, New Zealand, the Union of South Africa, the Irish Free State or the Government of India, or some or any of them, this agreement shall cease to apply to the territories under the authority or jurisdiction of those Governments respectively by or with whom this agreement has been terminated and to British ships registered in such territories.

6. Notice to terminate this agreement given by or to His Britannic Majesty's Government in Great Britain may, if so desired, exclude Newfoundland and all British ships registered therein from the operation of such notice, or may apply only to Newfoundland and all British ships registered therein as may be declared in the notice.

IN FAITH WHEREOF the undersigned have signed the present Agreement and have affixed thereto their seals.

Sir,

With reference to the agreement signed on June 24th, 1927, on behalf of His Britannic Majesty's Governments in Great Britain, Canada, the Commonwealth of Australia, New Zealand, the Union of South Africa and the Irish Free State, and the Government of India on the one part and the Government of the Latvian Republic on the other part, in regard to the measurement of tonnage of merchant ships, I desire to place on record the understanding that the stipulations of this agreement shall not be applicable to Iraq unless notice shall have been given of the desire of the Iraq Government that they shall be so applicable.

I have the honour to acknowledge the receipt of your Note No. 3510/50/59 of the 4th ultimo informing me of your desire to place on record the understanding that the stipulations of the Agreement signed on the 24th June, 1927, on behalf of the Government of the Latvian Republic on the one part and His Britannic Majesty's Governments in Great Britain, Canada, the Commonwealth of Australia, New Zealand, the Union of South Africa and the Irish Free State, and the Government of India on the other part, in regard to the measurement of tonnage of merchant ships, shall not be applicable to Iraq unless notice shall have been given of the desire of the Iraq Government that they shall be so applicable.

With reference to your Note No.1647 of the 12th September last, regarding the application to Iraq of the stipulations of the agreement which was signed at London on June 24th, 1927, in regard to the measurement of tonnage of merchant ships, I have the honour to inform you that the Iraq Government now desire that the stipulations of that agreement shall be made applicable to Iraq, and to enquire whether the Latvian Government consent thereto. In this event the Iraq Government will be notified that the stipulations of the Agreement are considered to be applicable to Iraq and from the date of such consent.

I have the honour to refer to my Note No. 2 of the 2nd instant, with reference to the Iraq Government's desire that the stipulations of the agreement, signed at London on June 24th, 1927, in regard to the measurement of tonnage of merchant ships shall be applicable to Iraq.

I now have the honour to inform you that my Government consent to the stipulations of the above-mentioned Agreement being made applicable to Iraq, as from 20th January, I928, and that the last Minister for Foreign Affairs has communicated this information directly to His Britannic Majesty's Minister at Riga.

I have the honour to be, with the highest consideration, Sir, your most obedient, humble Servant.
