EXCHANGE OF NOTES (January 18, 1952) GIVING EFFECT TO THE CONVENTION BETWEEN HIS MAJESTY AND THE FEDERAL PRESIDENT OF THE REPUBLIC OF AUSTRIA REGARDING LEGAL PROCEEDINGS IN CIVIL AND COMMERCIAL MATTERS SIGNED AT LONDON, MARCH 31, 1931 AS BETWEEN CANADA AND AUSTRIA

Your Excellency,

I have the honour to refer to the notes which were exchanged between Your Excellency and myself on the 28th June, 1951, on the subject of the Convention between His Majesty in respect of the United Kingdom and the Federal President of the Republic of Austria, regarding legal Proceedings in Civil and Commercial Matters signed at London on the 31st March, 1931. The accession of Canada to the above-mentioned Convention was notified to the Austrian Government on the 1st July, 1935.

At the instance of His Majesty’s Government in Canada I have the honour to propose that effect shall be given to the aforesaid Convention, as from the date of this Exchange of Notes, in respect of Canada and that the Convention shall continue in force in accordance with the provisions of Article 15.

The authorities in the various Provinces and Territories of Canada to whom requests for service or for the taking of evidence should be transmitted and the language in which communications and translations should be made are as follows:

If the Austrian Government are prepared to accept the above proposals, I have the honour to suggest that the present note and Your Excellency’s reply to that effect should be regarded as constituting an agreement between His Majesty’s Government in Canada and the Austrian Government which shall take effect this day the 18th January, of 1952.

I have the honour to confirm the receipt of your Note of 18th January, 1952, which reads as follows:-

I have the honour to inform you that the Austrian Federal Government accept the above proposals and agree that your Note and the present reply should be regarded as constituting an agreement between the two Governments which shall take effect this day.
