EXCHANGE OF NOTES BETWEEN CANADA AND NORWAY MODIFYING THE AGREEMENT OF 1950 CONCERNING AIR SERVICES

Sir,

Upon instructions from my Government, I have the honour to inform you that the Scandinavian Airlines System is now in a position to inaugurate a service to Montreal and that a proposal for the modification of paragraph 2 of the Annex to the Agreement between Norway and Canada for Air Services between the two countries, signed at Ottawa on February 14, 1950, has been made by the competent Norwegian aeronautical authorities under the terms of Article 8 of the Agreement to the competent Canadian aeronautical authorities. It is understood that the latter have now agreed to the proposed changes to the said Agreement and, accordingly, it would now be in order to confirm the agreement between the aeronautical authorities of our respective countries by an exchange of notes.

It is further understood that the competent Canadian aeronautical authorities wish to take this opportunity to modify paragraph 4 of the Annex to the said Agreement to enable the designated airline of the Government of Canada to serve routes originating and terminating at any point in Canada.

I now have the honour to propose that paragraph 2 of the Annex to the Agreement between Norway and Canada be amended to read as follows:

“The route to be operated by the designated airline of the Government of Norway shall be: Norway via intermediate points to Montreal and to points in countries beyond-in both directions,”

And that paragraph 4 be amended to read as follows:

“The route to be operated by the designated airline of the Government of Canada shall be: Canada via intermediate points to Oslo and to points in countries beyond-in both directions.”

If the Canadian Government is prepared to accept this proposal, I have the honour to suggest that this Note and your reply thereto shall constitute an agreement between the two Governments which shall take effect on the date of your reply.

Excellency,

I have the honour to acknowledge your Note X-8/58 of May 16, 1958 in which you propose that there should be an amendment to the Agreement for Air Services between Norway and Canada signed at Ottawa on February 14, 1950.

The appropriate Canadian authorities concur in your suggestion that paragraph 2 of the Annex to the Agreement between Norway and Canada be amended to read as follows:

“The route to be operated by the designated airline of the Government of Norway shall be Norway via intermediate points to Montreal and to points in countries beyond-in both directions.”

and that paragraph 4 of the Annex be amended to read as follows:

“The route to be operated by the designated airline of the Government of Canada shall be Canada via intermediate points to Oslo and to points in countries beyond-in both directions.”

I confirm that your Note and this reply thereto shall constitute an Agreement between Canada and Norway which shall take effect on this day, May 16, 1958. This Agreement shall be registered by the Canadian Government with the International Civil Aviation Organization in accordance with the terms of Article 7 of the Agreement between Canada and Norway for Air Services signed at Ottawa on February 14, 1950.
