Agreement between the Government of Canada and the Government of the Republic of Italy concerning the Sale in Italy of Waste Material and Scrap belonging to the Command of the Royal Canadian Air Force in Italy [1961] CATSer 8 (18 December 1961)

AGREEMENT BETWEEN THE GOVERNMENT OF CANADA AND THE GOVERNMENT OF THE REPUBLIC OF ITALY CONCERNING THE SALE IN ITALY OF WASTE MATERIAL AND SCRAP BELONGING TO THE COMMAND OF THE ROYAL CANADIAN AIR FORCE IN ITALY

THE GOVERNMENT OF CANADA AND THE GOVERNMENT OF THE REPUBLIC OF ITALY;

CONSIDERING that the Government of Canada acting through the Command of the Royal Canadian Air Force in Italy envisages the disposal of waste material and scrap in Italy, which is the property of the Government of Canada, and desires to dispose of such material in Italy or by export direct from Italy;

CONVINCED that the disposal of such material will be beneficial both to the Italian economy and to the Command of the Royal Canadian Air Force in Italy;

NOTING that the Government of the Republic of Italy agrees that the Command of the Royal Canadian Air Force in Italy may dispose of waste material and scrap which is Canadian property;

HAVE AGREED upon the following conditions:

ARTICLE I

The Command of the Royal Canadian Air Force in Italy is free to sell to persons, firms or other non-Government organizations authorized to do business in Italy, waste material and scrap, including ferrous and non-ferrous scrap, no longer utilizable by said Command and on supply thereto, for a total aggregate sales value not exceeding 100,000 U.S. dollars during the first year and not exceeding 50,000 U.S. dollars during each subsequent calendar year.

These amounts, exclusive of possible sales to Italian Government organ­izations, may be increased by mutual agreement in order to meet requirements in any given year.

ARTICLE II

The Command of the Royal Canadian Air Force in Italy shall notify the Italian Government of the quality, quantity, value, location and place of sale of the waste material and scrap which it intends to dispose of.

ARTICLE III

If so requested, the Italian Air Force shall act as representative of the Command of the Royal Canadian Air Force in Italy for the sale of waste material and scrap belonging to said Command. Such sales shall be affected in accord­ance with the principles normally adopted for the sale of property belonging to the Italian Government and following a procedure to be jointly agreed upon by the Italian Air Force and the Command of the Royal Canadian Air Force in Italy.

ARTICLE IV

For the importation of this material into Italy, the Italian Government shall grant all technical and administrative facilities compatible with existing Italian law.


ARTICLE V

The Command of the Royal Canadian Air Force in Italy is free to sell direct to foreign persons, firms and organizations, waste material and scrap, including ferrous and non-ferrous scrap, on supply to said Command and intended solely for export, without any limitation or restriction with regard to types, quantities and value of the waste material and scrap concerned. Export sales of such waste material and scrap to persons, firms or other organizations authorized to do business in Italy shall be subject to specific approval by the Italian Govern­ment. It is understood that if the Italian Government advances no objection to an export sale within thirty days of the date of dispatch of a request sub­mitted by the Command of the Royal Canadian Air Force in Italy, the author­ization shall be considered as automatically granted.

ARTICLE VI

Export sales effected under this Agreement shall be subject to existing Italian Customs bonding procedures. It is understood that waste material and scrap sold exclusively for export, under this Agreement, shall not be subject to Custom duties levied by the Italian Government.

ARTICLE VII

It is understood that any lira proceeds of sales of waste material and scrap by the Command of the Royal Canadian Air Force in Italy may be used for any Canadian Government expenditures in Italy.

ARTICLE VIII

This Agreement shall come into force upon signature and shall remain in force until 31 December 1962 and shall be considered as automatically extended from year to year unless either one of the Contracting Parties shall notify, at least two months in advance of the end of each calendar year, its intention, to terminate the said Agreement.

ARTICLE IX

The Contracting Parties also reserve the right to request, at least two months in advance, renegotiation of any clause of this Agreement.

DONE IN Rome, in duplicate, in the English and Italian languages, both texts being of equal authenticity, on this 18th day of December 1961.
