Sir,

I have the honour to propose to Your Excellency, on instructions from my Government, that an Agreement be concluded between our two Governments to permit amateur radio stations of Canada and Costa Rica to exchange messages or other communications from or to third parties under the following conditions:

Amateur stations of Canada and Costa Rica may exchange messages or other communications from or to third parties, provided

(a) the amateur stations exchanging such third party communications are not paid any direct or indirect compensation therefor; and

(b) such communications shall be limited to conversations or messages of a technical or personal nature, for which, by reason of their unimportance, recourse to the public telecommunications service is not justified.

If the Government of Costa Rica is prepared to accept the foregoing provisions, I have the honour to suggest that this Note and your reply thereto shall constitute an Agreement between our two Governments which shall have effect from the date of your reply. This Agreement shall be subject to termination at any time on sixty days notice by either Government.

Ambassador of Canada

Your Excellency:

I have the honour to refer to your communiqué No. 20 of July 14, 1961, concerning a draft Agreement between Costa Rica and Canada to permit radio ham stations of both countries to exchange messages and other communications under the following conditions:

(a) Radio ham stations exchanging such communications from third persons will not be paid or receive any direct or indirect compensation for these services.

(b) Such communications will be limited to conversations or messages of such technical or personal nature that due to their insignificance it will not be justified to send them by public services Telecommunication Companies.

In this connection I am pleased to inform Your Excellency that the Government of Costa Rica - through this Chancellery - agrees to consider the present Exchange of Notes as an Agreement between our Governments to be in force from this date on. The Agreement could be denounced by anyone of the two Contracting Parties. The denouncement will be in force sixty days after notice is given to the other Contracting Party.

I avail myself to this opportunity to renew to Your Excellency the expressions of my highest and most distinguished esteem.
