Minister of Foreign Affairs,
Jakarta

Excellency,

I have the honor to refer to the agreement effected by an Exchange of Notes between our governments on March 16, 1973 and in force since October 24, 1973 relating to the promotion of investments of Canadian private capital in Indonesia and to the insurance of such investments by the Government of Canada, through its agent the Export Development Corporation, and to propose that paragraph 1 and 5 of that agreement be amended as follows:

(A) In paragraph 1, the words "for which a document of admission has been issued" shall be deleted and replaced by the word "permitted".

(B) Paragraph 5 shall be deleted and replaced by the phrase "this agreement shall apply only with respect to insured investments in projects or activities which are permitted by the Government of the Republic of Indonesia or by an agency thereof".

If these proposals meet with the approval of the Government of the Republic of Indonesia, I have the honour to propose that this Note, which is equally authentic in English and French, and your reply to that effect, shall constitute an agreement to amend paragraphs 1 and 5 of the agreement constituted by the Exchange of Notes of March 16, 1973 as stipulated hereinabove and to propose that this agreement enter into force on the date of your reply covering all Canadian investments previously permitted by the Government of the Republic of Indonesia or an agency thereof.

Please accept, Excellency, the renewed assurances of my highest consideration.

Excellency,

I have the honour to acknowledge receipt of your Note dated July 14, 1984 which reads as follows:

"(See Canadian Note No. 098 of July 14, 1984)"

I confirm that the foregoing provisions are acceptable to the Government of the Republic of Indonesia and that your Note of July 14, 1984 and this reply thereto constitute an Agreement between our two Governments which shall enter into force on the date of this reply covering all Canadian investments previously permitted by the Government of the Republic of Indonesia or an agency thereof.
