EXCHANGE OF NOTES BETWEEN THE GOVERNMENT OF CANADA AND THE GOVERNMENT OF THE PEOPLE'S REPUBLIC OF CHINA CONSTITUTING AN AGREEMENT RENEWING THE TRADE AGREE­MENT OF OCTOBER 13, 1973

The Honourable James Kelleher,
Minister for International Trade
of Canada

Your Excellency,

I have the honour to refer to the Trade Agreement between the Government of the People's Republic of China and the Government of Canada, done at Peking on October 13, 1973, Article X of which stipulates:

"This Agreement shall come into force on the date of signature and shall remain in force for three years. The validity of this Agreement may be extended for another three years if the two Contracting Parties agree thereto not less than three months prior to the expira­tion of this Agreement."

In accordance with this provision, the validity of the Trade Agreement has been extended three times by Exchanges of Notes between our two governments and will expire once again on October 13, 1985, pursuant to the Exchange of Notes of December 3, 1982.

In view of the ever-developing economic, technological cooperation and trade between China and Canada, our respective governments deem it necessary to renew once again the validity of the Trade Agreement and to revise Article X thereof.

I have therefore the honour to propose the following:

1. The period of validity of the Trade Agreement shall be further extended from October 13, 1985 to October 13, 1988, and

2. The provisions of Article X of the Trade Agreement shall be deleted and the following substituted therefor:

"This Agreement shall come into force on the date of signature and shall remain in force for three years. The Agreement shall automati­cally be extended for successive terms of three years if neither Contracting Party notifies the other of its intent to terminate the Agreement at last three months before its expiry."

I have the honour to propose that if the foregoing is acceptable to your Govern­ment, this Note, together with your reply, shall constitute an Agreement between our two Governments which shall enter into force on the date of your reply.

Your Excellency,

I have the honour to acknowledge receipt of your Note of July 16, 1985, the content of which reads as follows:

"(See Chinese Note of July 16, 1985)"

On behalf of the Government of Canada, I have the honour to confirm that the foregoing is acceptable to my Government and that your Note and this Note which is authentic in English and French shall constitute an agreement between our two Governments which shall enter into force on the date of this reply.

Please accept, Excellency, the assurances of my highest consideration.
