AGREEMENT BETWEEN GOVERNMENT OF CANADA AND THE EUROPEAN SPACE AGENCY CONCERNING THE PARTICIPATION OF CANADA IN THE DEVELOPMENT AND EXPLOITATION PHASES OF THE ERS-1 PROGRAMME

The Canadian Government (hereinafter referred to as "Canada") and the European Space Agency, established by the Convention opened for signature in Paris on 30 May 1975 (hereinafter referred to as "the Agency"),

RECALLING the Cooperation Agreement between Canada and the Agency signed in Montreal on 9 December 1978,

CONSIDERING the Agreement governing cooperation between Canada and the Agency signed on 9 January 1984, which entered into force with effect from 1 January 1984 (hereinafter referred to as "the Cooperation Agreement"),

CONSIDERING that Canada has participated in the European remote sensing satellite preparatory programme, in Phase B of the European remote sensing satellite programme and in the extension of this Phase B,

CONSIDERING that certain Member States of the Agency have undertaken the development and exploitation phases of the ERS-1 programme under the terms of a Declaration dated 11 July 1984 (ESA/PB-RS/XXIX/Dec. 1 (Final)),

HAVING REGARD to Canada's request to participate in the said phases and the acceptance of this request by the participating States,

HAVE AGREED AS FOLLOWS:

ARTICLE I

The aim of this Agreement is to define the modalities of Canada's participation in the development and exploitation phases of the ERS-l programme (Phases C/D/E), as defined in the Declaration referred to in the preamble, which Canada has subscribed.

ARTICLE II

For the purposes of the execution of Phases C/D/E of the ERS-l programme, Canada has the rights and obligations of a participating State, as defined in the Declaration referred to in the preamble, in the Implementing Rules, and in all the other decisions governing the execution of the said programme.

ARTICLE III

Canada shall contribute to the expenditure resulting from the execution of Phases C/D/E of the ERS-1 programme as provided for in the Declaration referred to in the preamble.

ARTICLE IV

In accordance with Article V(b) of the Cooperation Agreement, Canada shall be represented by two delegates, who may be accompanied by advisers, at meetings of the States participating in Phases C/D/E of the ERS-l programme and held within the framework of the Remote Sensing Programme Board.

ARTICLE V

Canada and the Agency may, by mutual agreement, revise the conditions of this Agreement in the light of experience in order to improve in particular its application.

ARTICLE VI

1. This Agreement shall enter into force on the date of its signature by both parties.

2. It shall remain in force until completion of the ERS-1 programme (Phases C/D/E), the date of which will be notified to Canada by the Agency.
