Excellency:

I have the honor to refer to discussions between representatives of our two Governments concerning the establishment of a jointly staffed undersea surveillance facility in Halifax, Nova Scotia, in which our two Governments shall participate in the processing of undersea surveillance data and in the relaying of data from the Integrated Undersea Surveillance System (IUSS) in Argentia to the new facility.

As a result of those discussions, I have the honor to propose that the joint operation of an undersea surveillance system be implemented in accordance with a Memorandum of Understanding to be concluded by the United States Department of Defense and the Canadian Department of National Defence. I have the further honor to propose that if the terms set forth in this note are acceptable to your Excellency's Government, that this note and your note in reply shall constitute an Agreement between our two Governments which shall enter into force on the date of Your Excellency's note.

Excellency:

I have the honour to refer to your Excellency's Note 087 dated March 23, 1994, which read as follows:

I have the honour to inform your Excellency that the Government of Canada concurs in the proposal that the joint operation of an under-sea surveillance system be implemented in accordance with a Memorandum of Understanding to be concluded by the Canadian Department of National Defence and the United States Department of Defense.

Consequently, your Note and this Note in reply, which is equally authentic in English and French, shall constitute an Agreement between our two governments, which shall enter into force on this day.

Please accept, Excellency, the renewed assurances of my highest consideration.
