The Embassy of the Federal Republic of Germany presents its compliments to the Department of Foreign Affairs and International Trade and, with reference to the 7th meeting of the German-Canadian Cultural Commission on 12 and 13 May 1994, at which the Government of Canada requested that the Agreement of 30 May 1978 between the Government of the Federal Republic of Germany and the Government of Canada on Film Relations be amended, has the honour to propose that an Agreement be concluded between the Government of the Federal Republic of Germany and the Government of Canada amending the said Agreement as follows:

1. Sub-section (2) of Article IV of the Agreement of 30 May 1978 shall be amended as follows:

"(2) The minority co-producer shall contribute not less than thirty (30) per cent of the production cost of the film. If the production cost is exceptionally high or if the film is of particular importance for the two Contracting Parties, a minimum financial participation of twenty (20) per cent may be admitted by mutual agreement."

2. In all other respects the provisions of the Agreement of 30 May 1978 shall also apply to the present Agreement.

If the Government of Canada agrees to the proposals made by the Government of the Federal Republic of Germany, this Note Verbale and the Note in reply thereto from the Department of Foreign Affairs and International Trade expressing the agreement of the Government of Canada shall constitute an Agreement between the Government of the Federal Republic of Germany and the Government of Canada, to enter into force on the date of the Note in reply.

The Embassy of the Federal Republic of Germany avails itself of this opportunity to renew to the Department of Foreign Affairs and International Trade the assurance of its highest consideration.

The Department of Foreign Affairs and International Trade, presents its compliments to the Embassy of the Federal Republic of Germany and, with reference to the Embassy's Notes 84/95 of April 24, 1995, Ku 150/95 of July 26, 1995, and 189/95 of September 11, 1995, agrees to the proposals outlined in Note 84/95 to amend the Agreement of May 30,1978, between the Government of Canada and the Government of the Federal Republic of Germany on Film Relations.

The proposals contained in Note 84/95 and this reply shall constitute an Agreement between the Government of Canada and the Government of the Federal Republic of Germany, to enter into force on this day's date.

The Department of Foreign Affairs and International Trade avails itself of this opportunity to renew to the Embassy of the Federal Republic of Germany the assurance of its highest consideration.
