EXCHANGE OF NOTES AMENDING THE AGREEMENT FOR CO-OPERATION CONCERNING CIVIL USES OF ATOMIC ENERGY BETWEEN THE GOVERNMENT OF CANADA AND THE GOVERNMENT OF THE UNITED STATES OF AMERICA, DONE AT WASHINGTON JUNE 15, 1955, AS AMENDED AND SUPPLEMENTED

The Department of Foreign Affairs and International Trade presents its compliments to the Embassy of the United States of America and has the honour to refer to previous discussions concerning arrangements for the alteration in form or content of H. B. Robinson Nuclear Power Station fuel for the Direct Use of Spent PWR Fuel in CANDU (DUPIC) program.

The Department has the honour to propose that the Government of Canada and the Government of the United States of America hereby agree, pursuant to Article XII.E of the Agreement for Cooperation Concerning Civil Uses of Atomic Energy between the Government of Canada and the Government of the United States of America, signed June 15, 1955, as amended and supplemented, to the alteration in form or content of U.S.-origin nuclear material contained in irradiated fuel rods from the H.B. Robinson Nuclear Power Station to produce elements for irradiation in a research reactor, using a dry proliferation-resistant fabrication process in accordance with the plan contained in the document AECL/KAERI/US DOS Joint Development Program for the Direct Use of Spent PWR Fuel in CANDU (DUPIC), dated November 1995.

If the above proposal is agreeable to the Government of the United States of America, the Department has the honour to propose that this Note, which is equally authentic in English and French, and the affirmative reply, constitute an Agreement between the Governments that shall enter into force on the date of the reply.

The Department avails itself of this opportunity to renew to the Embassy of the United States of America the assurances of its highest consideration.

By Note No. IDN-1126 dated 17 April 1997, the Department of Foreign Affairs and International Trade proposed that the Government of Canada and the Government of the United States of America hereby agree, pursuant to Article XII.E of the Agreement for Cooperation Concerning Civil Uses of Atomic Energy between the Government of Canada and the Government of the United States of America, signed June 15, 1955, as amended and supplemented, to the alteration in form and content of U.S.- origin nuclear material contained in irradiated fuel rods from the H.B. The Embassy of the United States of America has the honor to confirm that the proposals set forth in the Department's Note are acceptable to the Government of the United States of America and that the Department's Note and this reply shall constitute an Agreement between the Government of the United States of America and the Government of Canada which shall enter into force on the date of this Note.

The Embassy takes this opportunity to renew to the Department of Foreign Affairs and International Trade the assurances of its highest consideration.
