AGREEMENT BETWEEN THE GOVERNMENT OF INDIA AND THE GOVERNMENT OF THE UNION OF SOVIET SOCIALIST REPUBLICS FOR RENDERING TECHNICAL ASSISTANCE TO INDIA IN EXPLORATION, DEVELOPMENT AND PRODUCTION OF OIL AND GAS [1960] INTSer 12

AGREEMENT BETWEEN THE GOVERNMENT OF INDIA AND THE GOVERNMENT OF THE UNION OF SOVIET SOCIALIST REPUBLICS FOR RENDERING TECHNICAL ASSISTANCE TO INDIA IN EXPLORATION, DEVELOPMENT AND PRODUCTION OF OIL AND GAS

New Delhi, 16 June 1960

With the common intention of further promoting friendly relations, between the two countries, and For the purpose of implementing the Additional Agreement between the Government of India and the Government of the Union of Soviet Socialist Republics of 12th February, 19601, in exploration, development and production of oil and gas, the Government of India and the Government of the Union of Soviet Socialist Republics have agreed upon the following :

Article 1

The Indian authorities shall, in collaboration with the Soviet Organisations hereinafter referred to as the said parties, carry out during the period 1960-65, within the framework of the terms and conditions of the Indian-Soviet Additional Agreement of 12th February, 1960, the complex exploration work for oil and gas in all its phases as well as production of oil and gas in Cambay and in such areas in India as may be specified from time to time by the Oil and Natural Gas Commission. The nature and scope of the aforesaid work shall be determined in accordance with the programmes and schedules to be prepared by the Oil and Natural Gas Commission in consultation with the Soviet Specialists and agreed upon by the said parties. It is understood herewith that the work of production shall include only drilling of production wells and putting up or installations necessary for storage of oil and gas within the producing fields.

Article 2

In pursuance of Article I this Agreement, the Soviet Organisations shall ensure :

I. Deliveries of equipment, apparatus and materials not available in India, in such quantities and within such periods as may be agreed upon by the said parties;

2. Deputing to India Soviet specialists of such categories, in such numbers, and for such periods as may be agreed upon by the said parties;

3. Training in the U.S.S.R. of Indian personnel for such purposes, in such numbers, and for such periods and in accordance with such programmes as may be agreed upon by the said parties;

4. Handing over to the Indian parties, by dates and in accordance with terms and conditions to be mutually agreed-upon between the Indian authorities and the Soviet Organisations, drawings and other technical documents to organise the manufacture in India of spare parts, units and tools for the equipment to be delivered to India from the U.S.S.R. in accordance with this Agreement.

The technical documents handed over to the Indian authorities shall be used exclusively at the Indian enterprises and not be transferred to any other country; deviations from this provision may be admitted with the consent of the Soviet Organisations in each separate case.

Article 3

Technical assistance to be rendered by the Soviet Organisations to the Indian authorities under this Agreement, shall be financed out of the credit of one milliard five hundred million roubles the Government of the Union of Soviet Socialist Republics have extended to the Government of India under the Indian-Soviet Agreement of 12th September, 1959 , and shall be in accordance with the terms and conditions of the Additional Agreement of 12th February, 1960, and within the amount provided by the parties at the time of conclusion of the said Additional Agreement for exploration, development and production of oil and gas. This amount will not exceed 277 million roubles.

Article 4

The Indian authorities and the Soviet Organisations, duly authorised by the Government of India and the Government of the Union of Soviet Socialist Republics respectively, shall enter into detailed contracts as may be necessary from time to time for the implementation of this Agreement.

Article 5

This Agreement shall come into force on the day of its signing.

DONE in New Delhi on the sixteenth day of June, 1960, in two original copies, each in the Hindi, Russian and English languages, all the three texts being equally authentic and the English text being the operative one.
