TRADE AGREEMENT BETWEEN THE GOVERNMENT OF THE REPUBLIC OF INDIA AND THE GOVERNMENT OF THE REPUBLIC OF TUNISIA

Tunis, 5 October 1960

The Government of the Republic of India and the Government of the Republic of Tunisia being desirous of developing closer trade relations between the two countries on the basis of equality and reciprocity have agreed as follows :

Article I

The Government of the Republic of India and the Government of the Republic of Tunisia will. accord to each other a treatment as favourable as possible to facilitate the exchange of goods between the two countries.

Article Il

Each country will extend to the other the facility for the importation of those goods which it allows to be imported freely within its territory.

Article III

The Government of the Republic of India shall apply to the products of the Republic of Tunisia still sub~ected to import restrictions and specially to the importation of items mentioned in List'T'annexed to this present agreement as favourable a treatment as accorded to similar goods imported from other countries subject to the trade control and financial regulations in force.

The Government of the Republic of Tunisia shall apply to the products of the Republic of India still subjected to import restrictions and specifically to the importation of items mentioned in List 'I' annexed to this agreement as favourable a treatment as accorded to similar goods imported from other countries subject to the trade control and financial regulations in force.

Article IV

The payment for the goods exchanged between the two countries in pursuance of this agreement will be made in freely convertible currency unless otherwise agreed to by the two parties.

Article V

A joint commission composed of the representatives of the two Governments will meet at the request of one or the other to review the implementation of the present agreement and to make suggestions to modify the lists of goods annexed hereto and recommend measures if any necessary to improve the development of trade between the two countries.

Article VI

This agreement shall come into force with immediate effect and shall be valid for one year. Thereafter it shall be renewable from year to year by tacit consent of the two parties unless rescinded on giving three months notice in writing by either party before its expiry.

DONE at Tunis on the 5th day of October 1960, in duplicate in English and in French, both texts being equally authentic.

Monsieur le President,

I have the honour to acknowledge receipt of your communication dated today the 5th October, 1960, which reads as follows

"Monsieur le President,

Au cours des negociations qui ont abouti a la signature en date de ce jour de Vaccord commerical entre nos deu-r pays, il a ete convenu que. pour favouriser les echnages prevus, l'Office due Commerce Exterieur de la Tunisie et la State Trading Corporation of India Ltd concluront un contract de compensation valuable pour une period de cinq ans et interessant certains produits indiens et tunisi en determines.

Les dispositions du contrat sousvise derogeront exceptionnellement aux modalitis de paiments ftes par Vaccord commercial.

Je vous prie de me confirmer votre accord sur ce qui precede.

Veuillex agreer Monsieur le President, Vassurance de ma haute consideration."

I hereby confirm that the above correctly sets out the understanding reached between our two delegations.

Au cours des negociations qui ont abouti a la signature en date de ce jour de Vaccord commercial entre nos deux pays, nous avons convenu exterieur de la Republique de l7nde, il Wapas ete possible de fixer des contingents auxproduits tunisiens rigurant sur la liste T annexee audit accord commerical.

Cependant le Gouvernement de la Republique de l7nde fera tout son possible pour faire importer sur son territoire les produits ci- apres darts la limite des contingents reproduits ci-contre

Laine lavee: 100 tonnes.

Fromage-Huile-D'olive-vinset liqueuers-Conserves de legumes, de fruits et de Poissons: 25,OOOD.

Mercure: 5,OOOD.

Je vous serais oblige de bien vouloir me confirmer votre accord sur ce qui precede.

Veuillez agreer, Monsieur le President, lassurance de ma haute consideration."
