EXCHANGE OF LETTERS BETWEEN THE GOVERNMENT OF INDIA AND THE GOVERNMENT OF THE HUNGARIAN PEOPLE'S REPUBLIC CONSTITUTING AN AGREEMENT ON COLLABORATION IN THE PEACEFUL DEVELOPMENT OF ATOMIC ENERGY

April 28,1961 Mr. Chairman,

I refer to the correspondence resting with Prof. Janossy's letter dated June 2- 1960, in connection with measures for collaboration in the peaceful Development of atomic energy proposed to be instituted between Hungary and India. These proposals were. also discussed during the very interesting and instructive visit Shri D.M. Thapar, Member for Finance and Administration, Atomic Energy Commission, and I paid to your country in October, 1959.

2. 1 am now glad to inform you that the Government of India operating through the Atomic Energy Commission, recognising the great importance of the development of atomic energy for peaceful purposes and desiring the promotion of measures which will enhance the friendly relations between the two countries, has decided to co-operate with the Hungarian Atomic Energy Commission in the research into and development of the peaceful uses of atomic energy.

3. In pursuance of this aim, the Indian Atomic Energy Commission and the Hungarian Atomic Energy Commission will:

(i) exchange information concerning the peaceful uses of atomic

energy, except information of a secret nature or information which either party is not free to exchange because it has been obtained from or developed in collaboration with a third party;

(ii) arrange for the visits of scientists as may be mutually agreed from time to time;

(iii) arrange for the sale or lease of materials and equipment as may be mutually agreed from time to time;

(iv) co-operate with each other in the implementation of such joint projects as may be mutually agreed from time to time;

(v) offer two fellowships each on a reciprocal basis for the training or visits of scientists in subjects as may be mutually agreed.

4. In conclusion, I suggest that the arrangements embodied in this letter and in your reply accepting them should constitute -an Agreement between our two countries for collaboration in the peaceful uses of atomic energy. This Agreement will be in force for a period of five years in the first instance, and may be renewed from time to time for such periods as the two parties may mutually agree. The Agreement may also by mutual consent be modified or expanded at any time and any part or parts of it embodied in supplementary detailed Articles of Agreement. It will come into force on receipt of your reply accepting these proposals.

HUNGARIAN PEOPLE REPUBLIC
NATIONAL ATOMIC ENERGY COMMISSION
BUDAPEST

24 August, 1961

Mr. Chairman,

I have the honour to refer to your letter dated April 28, 1961 and to previous correspondence between representatives of the Atomic Energy Commission of the Government of India and the National Atomic Energy Commission of the Hungarian People's Republic regarding measures for collaboration in the peaceful development of atomic energy suggested to be instituted between the Republic of India and the Hungarian People's Republic and to the proposals made thereon.

The Hungarian Government has authorized me to state that it also attaches great importance to the development of atomic energy for peaceful ends and desires to further the friendly relations between India and the Hungarian People's Republic through cooperation with the Atomic Energy Commission of the Government of India. Therefore, it welcomes the decision of the Government of India on co-operation and accepts the proposals that the Indian Atomic Energy Commission and the Hungarian Atomic Energy Commission

(A) exchange information concerning the peaceful uses of atomic energy except information of a secret nature or information which either part is not free to exchangE because it has been obtained from or developed in collaboration with a third party;

(b) arrange for the visits of scientists as may be mutually agreed -from time to time;

(c) arrange for the sale or lease of materials and equipment as may be mutually agreed from time to time;

(d) co-operate with each other in the implementation of such joint projects as may be mutually agreed from time to time;

(e) offer two fellowships each on a reciprocal basis for the training or visits of scientists in subjects as may be mutually agreed.

It is also accepted that your letter of April 28, 1961 and the present confirmation constitute an Agreement between our two countries for collaboration in the peaceful uses of atomic energy. This Agreement will be in force for a period of five years in the first instance, and may be renewed from time to time for such periods as the two parties may mutually agree. The Agreement may also by mutual consent be modified or expanded at any time and any part or parts of it embodied in supplementary detailed Articles of Agreement.

I have the honour to suggest that the two letters constituting the Agreement be made public on the 15th day of November, 1961 at the same time in both countries. If this proposal is accepted, I request you to inform me through the regular diplomatic channels.

It is also understood that the Agreement will come into force on receipt of the present letter.
