AGREEMENT BETWEEN THE GOVERNMENT OF INDIA AND THE GOVERNMENT OF THE COMMONWEALTH OF AUSTRALIA WITH RESPECT TO THE MUTUAL PROTECTION OF PRIORITY OF PATENTS FOR INVENTIONS

New Delhi, 23 January 1963

The Government of the Commonwealth of Australia and the Government of the Republic of India,

BEING desirous of protecting the priority of patents for inventions a reciprocal basis,

HAVE agreed as follows

1. The Governor-General of the Commonwealth of Australia shall, within three months after the date of signature of this Agreement, by Proclamation published in The Commonwealth of Australia Gazette, declare that the Republic of India is a Convention country for the purposes of the Patents Act 1952-1960 of the Commonwealth of Australia.

2. The Central Government of the Republic of India shall, within three months after the date of signature of this Agreement, by notification published in The Official Gazette of The Republic of India, direct that the provisions of Section Seventy-eight A of the Indian Patents and Designs Act, 1911, or the corresponding provisions of the Act relating to patents for the time being in force, shall apply for the protection of inventions patented in the Commonwealth of Australia.

3. (1) The Governor-General of the Commonwealth of Australia shall not revoke the Proclamation published in accordance with clause one of this Agreement until the expiration of three months after the Government of the Commonwealth of Australia shall have given notice to the Central Government of the Republic of India of its intention to revoke the Proclamation.

(2) The Central Government of the Republic of India shall not revoke the notification published in accordance with clause two of this Agreement until the expiration of three months after it shall have given notice to the Government of the Commonwealth of Australia of its intention to revoke the notification.

IN WITNESS WHEREOF the undersigned, being duly authorised by their respective Governments for the purpose, have, on the twenty-third day of January, One thousand nine hundred and sixty three, signed the present Agreement and affixed thereto their seals.
