AGREEMENT BETWEEN THE GOVERNMENT OF INDIA AND THE GOVERNMENT OF UGANDA ON FRIENDSHIP AND TECHNICAL, ECONOMIC AND SCIENTIFIC CO-OPERATION

Kampala, 18 November 1965

The Government of India and The Government of Uganda,

RECOGNISING the friendly ties which have existed between the peoples of Uganda and India in the past,

CONSIDERING that the people of Uganda and India have a common interest in economic progress and that their joint efforts to exchange technical knowledge and skills will assist in achieving this object,

BEING mutually desirous of advancing the closest possible cooperation in the technical, economic and scientific fields on the basis of equality and mutual benefit,

BELIEVING firmly that such cooperation between the peoples of the two countries will advance further the cooperative effort envisaged in the Joint Declaration of the 77 developing countries adopted by the United Nations Conference on Trade and Development held at Geneva in 1964,

HAVE agreed as follows :

Article 1

The Government of Uganda and the Government of India shall facilitate and promote, in conformity with the provisions of this Agreement, any form of technical, economic and scientific cooperation as they may deem useful to the economic advancement of their respective countries.

Article 2

The technical, economic and scientific cooperation between the two countries shall be effected through separate arrangements to be concluded between authorised institutions or bodies of the two countries subject to the approval of the two Governments and in accordance with laws and regulations in force from time to time in each country and in accordance with their international legal obligations in this matter.

Article 3

The technical, economic and scientific cooperation shall include, among others, the following activities having always in view their possible extension to such other forms as may be found mutually useful :

(a) exchange of personnel for training purposes, specialization in technical schools, scientific and other institutes, factories and other production centres in each country, grant of scholarships etc.

(b) exchange of experts visits with a view to lecturing, instructions and acquiring expert knowledge in the other country.

(c) loan of the services of experts.

(d) exchange and giving of technical documentation and necessary equipment, including also the exchange of corresponding information.

e) cooperation in scientific research, work between scientific institutes and bodies of the two countries, and exchange of information, books and scientific publications.

(f) setting up of joint industrial ventures.

(g) cooperation of scientific, technical, economic and industrial organisations in finding the most suitable technical solutions and attaining increased productivity.

Article 4

Both Governments shall appoint in their respective countries, organs which shall be charged with the execution of technical, economic and scientific cooperation as provided for in this Agreement. For the aforesaid purpose, the Government of Uganda nominates the Ministry of Planning and Community Development, Central Planning Bureau, P.O. Box 13, Entebbe, and the Government of India nominates the Ministry of External Affairs. The above organs shall keep in touch with each other on all questions relating to the realisation of the approved programmes of technical, economic and scientific cooperation.

Article 5

In order to establish periodically the volume and conditions of mutual technical, economic and scientific co-operation and to review the progress made, the representatives of the organs mentioned in Article 4 above shall meet either in Kampala or New Delhi as and when necessary. The decisions of these meetings shall be subject to the approval of the competent organs of both countries, as constituted by both Governments under Article 4.

Article 6

The terms and conditions of service of experts and trainees and of all other forms of technical, economic and scientific cooperation mentioned in Article 3 above shall be agreed upon in each case between the respective representatives of the contracting parties in individual arrangements as contemplated in Article 2 of the Agreement. Where necessary, the terms and conditions will also provide against the disclosure of such knowledge or information as may be acquired by the recipient party.

Article 7

Persons deputed under this Agreement shall be obliged to comply with laws and regulations in force from time to time of the country in which they perform their duties, render or carry on any activities.

Article 8

Each contracting party receiving assistance according to this Agreement shall, in so far as it may be permissible under the laws in force in the territory of such contracting party extend to the experts and/or trainees of the other party all the necessary facilities for the successful fulfilment of the duties under the Agreement.

Article 9

Further details regarding fulfilment of the obligations undertaken by the two Governments pursuant to this Agreement shall be separately defined in each case by exchange of letters between the two Governments or in such other suitable forms as may be agreed upon.

Article 10

The present Agreement shall remain in force for a period of five years. Thereafter, it shall continue to be in force unless either party terminates it by giving six month’s notice in writing to the other party.

The present Agreement shall come into force with effect from the date of the exchange of the Instruments of Ratification conforming to relevant regulations of the respective countries.

IN WITNESS WHEREOF the representatives duly authorised by their respective Governments, have signed this Agreement.

DONE AND SIGNED in English in two originals, both texts being equally authentic, in KAMPALA on the l8th day of November, 1965.

PROTOCOL

PROTOCOL TO THE AGREEMENT ON FRIENDSHIP AND TECHNICAL,
ECONOMIC AND SCIENTIFIC COOPERATION BETWEEN THE GOVERNMENT OF INDIA AND THE GOVERNMENT OF UGANDA

KAMPALA, 18 NOVEMBER 1965

The Government of Uganda and the Government of India,

WITHIN the framework and in the spirit of the Agreement on Friendship and Technical, Economic and Scientific Co-operation done and signed in Kampala this, l8th day of November, 1965,

AGREE as follows :

Article I

The Co-operation between the two countries will be based on the following terms :

The Indian Government shall provide :

1. (a) the full salary (including leave salary) and allowances accruing to the Indian Technical Assistance Personnel as a consequence of their services in Uganda;

(b) the full cost of international travel to and from Uganda for the personnel and their families;

(c) the cost of shipping to and from Uganda the personal household effects of the personnel and their families.

2. The Government of Uganda shall provide :

(a) transport to the personnel and their families from the point of entry to the duty station upon arrival in Uganda and from the duty station to the point of departure at the end of the assignment for the personnel and their personal belongings;

(b) to the personnel, transport for all official purposes within Uganda on the same terms as Government officers of similar status; (for official journeys performed by the personnel in their personal motor cars, a mileage allowance will be paid at appropriate Government rates);

(c) transport for approved supplies and equipment for official purposes from the point of entry and departure, and the duty station;

(d) for the personnel and their families adequate living accommodation of the standard provided for comparable Government officers at appropriate government rates; if the personnel and their families initially reside in an hotel, the Uganda Government shall fulfil its obligations by refunding to the personnel an amount equivalent to 50 per cent of the full hotel bill (board and lodging but excluding any extras such as laundry etc.), provided that the rate paid at the hotel is reasonable and that the hotel and particular accommodation therein occupied by the personnel and their families are not above the standard which an officer of the Government of Uganda of comparable status might reasonably expect;

(e) medical and hospital facilities for the personnel to the same extent as they are provided for national civil servants;

(f) the Uganda Government shall permit the personnel to take such leave during their service in Uganda as shall be agreed between the two Governments.

Article II

1. The Indian Technical Assistance Personnel shall be exempted from payment of customs duties on :
(a) wearing apparel;

(b) personal and household effects of any kind which were in the officers’ personal use in their former place of residence;

(c) one motor vehicle (new or used but not both) for their personal use or the purchase of such a motor vehicle within East Africa out of duty free stock within six months of their arrival in Uganda, provided that a motor vehicle imported under these privileges shall be liable for such duties and taxes if resold within two years in East Africa.

2. The personnel shall be exempted from income tax and graduated tax in respect of any emoluments paid directly to them by the Indian Government.

3. The personnel shall be accorded the same privileges in respect of exchange facilities as are accorded to the foreign technical assistance personnel of comparable rank serving in Uganda.
Article III

This Protocol shall come into force simultaneously with the Agreement on Friendship and Technical, Economic and Scientific Co-operation.

IN WITNESS WHEREOF the representatives duly authorised by their respective Governments, have signed this Agreement.

DONE and signed at Kampala this l8th day of November, 1965 in English in two originals both texts being equally authentic.
