EXCHANGE OF NOTES BETWEEN THE GOVERNMENT OF INDIA AND THE GOVERNMENT OF SPAIN REGARDING CO-OPERATION IN THE RESEARCH AND DEVELOPMENT OF ATOMIC ENERGY FOR PEACEFUL PURPOSES [1965] INTSer 6

EXCHANGE OF NOTES BETWEEN THE GOVERNMENT OF INDIA AND THE GOVERNMENT OF SPAIN REGARDING CO-OPERATION IN THE RESEARCH AND DEVELOPMENT OF ATOMIC ENERGY FOR PEACEFUL PURPOSES

LETTERS

The Spanish Embassy presents its compliments to the Department of Atomic Energy and has the honour, to refer to the visit of the President of the Junta de Energia Nuclear to India last year and to the visit of the Chairman of the Indian Atomic Energy Commission to Spain in 1958 and 1964, and to the desire expressed by both high officials to co-operate in the development of atomic energy for peaceful purposes. The Spanish Embassy is glad to inform the Department of Atomic Energy that the Government of Spain, recalling the friendly co-operation which has already existed between the two countries in this field, and desirous of extending this co-operation, and recognising further the great importance of the development of atomic energy for peaceful purposes, has decided to conclude an Agreement of co-operation in the research into and the development of the uses of atomic energy for peaceful purposes with the Government of India. 1C is proposed that this Agreement should provide a broad frame-work for collaboration, under which detailed Articles of Agreement can be negotiated separately by the Junta de Energia Nuclear of Spain and the Department of Atomic Energy of the Government of India.

In pursuance of this aim, the Government of Spain and the Government of India agree :

(i) To exchange freely information concerning the peaceful uses of atomic energy and research connected therewith, except information of a secret nature or information which either party is not free to exchange, because it has been obtained from or developed in collaboration with a third party, or information which is of commercial value and which the party transmitting it desires to be subject to a special arrangement;

(ii) To arrange for the visits of scientists and technical personnel and granting of fellowships as may be mutually agreed from time to time; .

(iii) To extend facilities for the procurement and sale of nuclear materials and equipment required by either party to this Agreement on a commercial basis;

(iv) To co-operate with each other in the implementation of such joint projects as may be mutually agreed from time to time; for this purpose, the parties to this Agreement will investigate the possibility of embarking on joint research projects and programmes and of collaborating in other ways also.

In conclusion, the Spanish Embassy proposes that the arrangements embodied in this Note and in the reply of the Department of Atomic Energy thereto should constitute an Agreement between Spain and India for collaboration in the development and uses of atomic energy for peaceful purposes. The Agreement will be in force for a period of five years in the first instance and may be renewed from time to time for such periods as the two parties may mutually agree. The Agreement may also; by mutual consent, be modified or expanded at any time and any part or parts of it embodied in supplementary detailed Articles of Agreement. It will come into force on receipt by the Spanish Embassy of the reply of the Department of Atomic Energy accepting the proposals contained in this Note.
The Spanish Embassy avails itself of this opportunity to renew to the Department of Atomic Energy the assurances of its highest consideration.

NOTE VERBALE

The Department of Atomic Energy presents its compliments to the Embassy of Spain and has the honour to, acknowledge its Note Verbale of the 27th of March, 1956, proposing that the Government of Spain and the Government of India conclude an Agreement on a joint collaboration in the field of the peaceful uses of nuclear energy and for this purpose agree :

(i) To exchange freely information concerning the peaceful uses of atomic energy and research connected therewith, except information of a secret nature or information which either party is not free to exchange, because it has been obtained from or developed in collaboration with a third party, or information which is of commercial value and which the party transmitting it desires to be subject to a special arrangement;

(ii) To arrange for the visits of scientists and technical personnel and granting of fellowships as may be mutually agreed from time to time; .

(iii) To extend facilities for the procurement and sale of nuclear materials and equipment required by either party to this Agreement on a commercial basis;

(iv) To co-operate with each other in the implementation of such joint projects as may be mutually agreed from time to time; for this purpose, the parties to this Agreement will investigate the possibility of embarking on joint research projects and programmes and of collaborating in other ways also.

2. On behalf of the Government of India, the Department of Atomic Energy is pleased to express full approval of the above proposals and to confirm that (a) these arrangements will constitute the Agreement of Co-operation, which will provide a broad frame-work for collaboration under which detailed Articles of Agreement can be negotiated separately by the Junta de Energia Nuclear of Spain, and the Department of Atomic Energy of the Government of India, (b) the Agreement will be in force for a period of five years in the first instance and may be renewed from time to time for such periods as the parties may mutually agree and (c) the Agreement may by mutual consent be modified or expanded at any time and any part or parts of it embodied in supplementary detailed Articles of Agreement, the Department of Atomic Energy finally agrees that the Agreement will enter into force from to-day the 27th of March, 1965.

The Department of Atomic Energy avails itself of this opportunity to renew to the Spanish Embassy the assurances of its highest consideration.
