MEMORANDUM OF UNDERSTANDING BETWEEN THE GOVERNMENT
OF INDIA AND THE GOVERNMENT OF THE FEDERAL REPUBLIC OF GERMANY REGARDING REPLACEMENT OF THE ROUTE SCHEDULE

Bonn, 24 January 1969

The consultations envisaged in the Agreed Minutes signed at New Delhi on 28th May 1968 were held in Bonn from January 20 to 24, 1969.

A. It was agreed that the Route Schedule to the Air Services Agreement between the Government of India and the Federal Republic of Germany signed on May 31, 1963 be amended to read as follows, in replacement of the Route Schedule as contained in the Exchange of Notes dated 31 May 1963;

Route Schedule

I. Routes to be operated in both directions by the airline designated by the Federal Republic of Germany

II. Routes to be operated in both directions by the airline designated by the Government of India.

III. A designated airline may if it so desires omit one or more points on the specified routes.

B. It was also agreed that the arrangements contained in the Exchange of Letters dated 31 May, 1963 and 29 December, 1967 shall stand terminated as of this day’s date and shall be replaced by the following :

(a) The airline designated by the Government of the Federal Republic of Germany shall be authorised to operate a total number of 5 services a week on the specified routes via the points indicated for each of such specified routes respectively.

With effect from April 1, 1970 the airline designated by the Government of the Federal Republic of Germany may operate a sixth weekly frequency through India on either of the specified routes.

(b) The airline designated by the Government of India shall be authorised to operate a total number of 5 services a week on the specified routes via the points specified for each of each specified routes respectively.

With effect from April 1, 1970 the airline designated by the Government of India may operate a sixth weekly frequency through the Federal Republic of Germany on either of the specified routes.

It was also agreed that the airline designated by the Government of India may operate on route II.1. two of their weekly services with full traffic rights via Moscow.

(c) The airline designated by the Government of the Federal Republic of Germany may at any one time, after notifying the aeronautical authorities, substitute Bombay for New Delhi as a point of call on the routes specified under I above.

Similarly, the airline designated by the Government of India may at any one time, after notifying the aeronautical authorities, substitute any other point in the Federal Republic of Germany for the second point selected by them.

(d) The airline designated by the Government of India may, on a flight, occasionally make double landing at the same point in the Federal Republic of Germany. Likewise the airline designated by the Federal Republic of Germany may, on a flight, occasionally make double landing at the same point in India. Prior notice of such double landing should be given to the aeronautical authorities, and it will be subject to their concurrence which will not normally be withheld.

(e) The designated airline of both Contracting Parties may operate any or all the frequencies with any equipment they choose, provided that Boeing 747 Aircraft may be operated upto two frequencies per week until an agreement is reached between both sides for increasing such frequencies on the basis of 3rd, 4th and 5th freedom traffic, as soon as relevant decisions about tariffs and other connected matters consequent on the operation of Boeing 747 are know.

The above arrangements will be given effect as on this day’s date, pending their formalisation through Exchange of Notes and/or letters.
