AGREEMENT BETWEEN THE GOVERNMENT OF INDIA AND THE GOVERNMENT OF THE POLISH PEOPLE'S REPUBLIC ON COOPERATION IN MARINE FISHERIES

New Delhi, 6 April 1973

The Ministry of Agriculture of the Republic of INDIA

AND

The Ministry of Shipping of the POLISH PEOPLE'S REPUBLIC

BEING animated by the intention to strengthen friendly relations between both the countries and mutually interested to cooperate in the sphere of sea fishing,

HAVE decided to enter into following Agreement :

PARA I

The Indian side and the Polish side will cooperate in selected sectors in any of the following fields as mutually agreed upon :

- Survey of fishing resources,

- Technology relating to the catching and processing of fish and fish products,

- Supply of fishing trawlers suited to the requirements of Indian fishery,

- Technical assistance in construction of fishing trawlers including supply of drawings, specifications and other technical documentation and advice,

- Supply of necessary equipment for the construction of fishing trawlers and technical assistance for the construction of necessary equipment,

- Organization of workshops and technical facilities for the servicing of fishing vessels,

- Assistance in designing of fishing harbours development,

- Supply of equipment and complete plans for freezing and processing of fish.

PARA II

Joint Ventures will be within the scope of cooperation. Both sides will secure such facilities and privileges in respect of taxes, custom duties, credits, transfer of profits and return of capital stocks as may be in accordance with their respective laws and regulations.

PARA III
The Polish side would be willing to provide the Indian side technical assistance in training personnel for Indian fishing industry both practically and in technical schools and fishing enterprises in Poland as well as to provide assistance in on-the-spot instruction of the Indian staff by deputing Polish sea fishing experts to work with relevant Indian organizations.

PARA IV

The Polish side would be willing to provide the Indian side scientific and technical assistance in the field of fisheries development in India, in the survey of fisheries potentials and elaboration of respective programmes.

PARA V

Precise details of the mutually acceptable selected areas out of those listed in Para I and the forms and terms of cooperation as stipulated under Paras I, II, III and IV of the present Agreement will be mutually determined by the competent organizations or authorities which will be indicated by both sides within one month after signing of the present Agreement.

PARA VI

The Parties to the present Agreement appoint Plenipotentiaries to supervise the implementation of the said Agreement. Besides supervising the implementation of the Agreement, the Plenipotentiaries will, on behalf of, and subject to the decisions and directions of, their respective Governments, undertake the resolution of problems relating to the clearance including documentary clearance of Polish fishing vessels and crews visiting Indian ports under the terms of this Agreement, and the grant of import and export licences by the respective Governments.

On the part of the Ministry of Agriculture of the Republic of India, the plenipotentiary will be the Fisheries Division of the Ministry of Agriculture and on the part of the Ministry of Shipping of the Polish People's Republic the plenipotentiary will be the Foreign Department in the Ministry of Shipping.

The Plenipotentiaries will meet at intervals of not less than one year, alternatively in either country. Locations and dates of these meetings will be determined in each instance.

PARA VII

Provisions of the present Agreement are without prejudice to the position of either Party regarding the extent of exclusive fisheries jurisdiction or arrangement between either of the two signatories and third parties.

PARA VIII

The present Agreement will come into force from the date of signing of the Agreement and will be in force initially for a period of five years, subject to renewal for a further period mutually agreed upon, provided that either Party will have the option to terminate the Agreement by giving six months’ notice in writing to the other.

The present Agreement has been made in New Delhi on the Sixth day of April 1973 in two originals in English language both texts being equally authentic and valid.
