If the Magistrate after taking the evidence adduced for the prosecution and the defence is of opinion that the accused is guilty of an offence which cannot be adequately punished by a Magistrate's court he shall not convict the accused but shall for- ward the record of the record of the case to the Director of Public Prosecution. |
