Form of notice of appeal

323.
(1) Every notice of appeal shall contain the particulars prescribed by rules of court, shall be signed by the appellant or his registered attorney, and shall bear a stamp of the prescribed denomination:
(2) If judgment be given in whole or in part in favour of the appellant, the amount of stamp fee shall be returned to him.
