Administration of Justice Law (No. 44 of 1973) - Sect 358

Notice praises Destructive

358. Before the record of any case is destroyed:-
(a) the court shall give notice to the parties to the case, either orally or in the manner prescribed by law for the service of summons, of the intended destruction:
(b) any party to, or any person interested in, such case shall, on application made to the court, be entitled to receive on payment of the prescribed fee a certified copy of the record of such case or any part thereof;
(c) subject to me provisions of paragraph (d),any Party to such case or any heir or attorney of such party shall, on application made to the court, be entitled to receive any original deed, certificate, survey plan or other document produced by such Party during the course of the proceedings in such case;
(d) It shall be lawful for the Director of National Archives or any officer authorized by him in that behalf to inspect the record of such ease and remove therefrom, with the permission of the court, for preservation in the National Archives any document, which, in the opinion of such Director or officer, is of historical value;
(e) the court shall cause the judgment and decree, if any, entered in such case and, subject to the provisions of paragraphs (c) and (d), all original deeds, certificates and survey plans produced In the case to be extracted there-from, and It shall be the duty of the court to preserve every such document.
