Births and Deaths Registration (Amendment) Act (No. 37 of 2006) - Sect 2

Amendment of section 6 of (Chapter 110)

2. Section 6 of the Birth and Deaths Registration Act (Chapter 110) is hereby amended by the insertion of the following new subsection, immediately after subsection (4) thereof : -
" (5)
(a) A person shall be disqualified from being appointed or continuing as a Registrar, or Deputy Registrar, if he : -
(i) becomes a Member of Parliament ; or
(ii) becomes a Member of a Provincial Council ; or
(iii) becomes a Member of a local authority ;
(iv) is holding any paid officer under the Republic ; or
(v) is engaged in a profession that would prejudicially affect the duties of a Registrar.
(b) Where any Registrar or Deputy Registrar becomes disqualified by virtue of paragraph (a) of this sub-section, the Registrar-General shall have the power to make an order of removal of such person from the post of Registrar or Deputy Registrar with the approval of the Minister by Order published in the Gazette, and such removal shall take effect on the date specified in the Gazette.
(c) In the event of a vacancy occurring in the post of a Registrar or Deputy Registrar as a result of any resignation or any removal from office, another person shall, having regard to the provisions of this section, be appointed to fill the vacancy.
(d) Where another person is appointed to fill a vacancy under this section, the person so appointed shall hold such office for the unexpired part of the term of office of a Registrar or Deputy Registrar as the case may be whom he succeeds.".
