| (1) The Registrar may refuse to register any firm or person carrying on business under a business name if he is satisfied that the use of the business name is contrary to any law for the time being in force or is a business name the use of which is prohibited under section 8. |

| (2) The registration of a business name under this Act shall not be construed as authorizing the use of that name if apart from such registration the use thereof could be prohibited. |
