38.
| (1) Any expense incurred by the Authority in any suit or prosecution brought by or against it before any court, shall be paid out of the Fund of the Authority and any costs paid to or recovered by the Authority in any such suit or prosecution shall be credited to the fund of the Authority. |

| (2) Expense incurred by any member the Director-General or any officer or servant of the Authority in any suit of prosecution brought against him or her before any court or tribunal in respect of any act which is done or purported to be done by him or her under the provisions of this Act or any other written law or on the direction of the Authority shall; if the court hold that such act was done in good faith, he paid out of the Fund of the Authority, unless such expenses are recoverable by him or her in such suit or prosecution. |
