Presentation of schemes to Minister for approval

25.
(1) Upon the completion of the preparation of a voluntary transfer scheme by the Board and any local authority under this Act, the Board shall present such scheme to the Minister for his approval, and upon such presentation the Minister shall, with the concurrence of the Minister of Local Government, either approve such scheme without modification, or approve such scheme with any such modifications as may be agreed upon by the Minister, the Board and such authority, or, in the absence of such agreement, as may be decided upon a reference by the Minister to arbitration, as hereinafter provided, of any matter which cannot be so agreed upon.
(2) Upon the completion of the preparation of a compulsory transfer scheme by the Board under this Act, the Board shall present such scheme to the Minister for his approval, and upon such presentation the Minister shall, with the concurrence of the Minister of Local Government, either approve such scheme without modification, or approve such scheme with any such modifications as the Minister may deem necessary.
(3) In exercising his power of approval in respect of any transfer scheme under sub-section (1) or sub- section (2), the Minister shall have particular regard to the necessity of ensuring that the transfer scheme makes adequate provision in respect of the matters specified in section 23.
(4) The Minister, the Board and any local authority shall be bound by the decision given on any matter referred to arbitration under sub-section (1).
