Code Of Criminal Procedure Act (No. 15 of 1979) - Sect 346

Procedure at the hearing

349.
(1) At the hearing of the appeal or application the court may call upon the appellant or applicant as the case may be and the respondent or their attorneys-at-law to make their submissions.
(2) Subject to the provisions of subsection (1), the appellant or the applicant shall first be heard in support of the appeal or application. The Court shall then, it if does not at once dismiss the appeal or application or affirm the judgment or order appealed from, hear the respondent and in such case the appellant or applicant shall be entitled to reply.
(3) If the appellant or applicant does not appear to support the appeal, or application the court shall consider the appeal or application and may make such order thereon as it may deem fit.
